Adjustment of Fixed ICI Design/Build Price. The Fixed ICI Design/Build Price for each Initial Capital Improvement as set forth in Appendix 6 shall be adjusted to account for any delay by any Governm ental Body in issuing any required Governmental Approvals for such Initial Capital Improvement beyond the Outside Approval Issuance Date set forth in subsection 11. 9(A); provided that the Lessee m ust affirmatively demonstrate that a Governmental Body's delay in issuing the required Governmental Approval was not due to the failure of the Lessee to exercise reasonable diligence in securing the Governmental Approval following subm ittal of the com plete application. To the extent the Lessee failed to subm it a completed application for an Initial Capital Improvement by the Governmental Approval Application Date, the Outside Approval Issuance Date for such Initial Capital Improvement shall be extended for each day of delay by the Lessee. Assuming the Lessee has affirmatively demonstrated that it is entitled to an adjustment of any portion of the Fixed ICI D esign/ Build Price hereunder, such am oun t of th e Fixed ICI D esign/ Build Price relating to the affected Initial Capital Improvement shall be adjusted based on the CPI from the Outside Approval Issuance Date to the date on which all required Governm ental Approvals to comm ence construction of the affected the Initial Capital Improvem ent are actually obtained.

  • Price Adjustments for OGS Centralized Contracts Periodic price adjustments will occur no more than twice per year on a schedule to be established solely by OGS. Pricing offered shall be fixed for the first twelve (12) months of the Contract term. Such price increases will only apply to the OGS Centralized Contracts and shall not be applied retroactively to Authorized User Agreements or any Mini-bids already submitted to an Authorized User. Price Decreases Price decreases may be made at any time. Additionally, some price decreases shall be calculated in accordance with Appendix B, section 17, Pricing.

  • Contract Price Adjustment The basis upon which the Contract Price shall be adjusted is as set out in paragraph 9.2 of Schedule IVB.

  • Workplace adjustment An employer wishing to employ a person under the provisions of this clause shall take reasonable steps to make changes in the workplace to enhance the employee’s capacity to do the job. Changes may involve re-design of job duties, working time arrangements and work organisation in consultation with other employees in the area.

  • Price Schedule, Payment Terms and Billing, and Price Adjustments (a) Price Schedule: Price Schedule under this Contract is set forth in Exhibit B.

  • Price Adjustment Civil works contracts of long duration (more than 18 months) shall contain an appropriate price adjustment clause.

  • Contract Term Adjustment “Contract Term Adjustment” means adjustment only as provided for in the three circumstances described in this Subsection. Under these circumstances, the contract term shall be adjusted in writing to include additional calendar days in one or more Normal Operating Seasons equal to the actual time lost, except as limited by paragraph (b) in this Subsection. To qualify for such adjustment, Purchaser shall give written notice of the lost time not later than 30 days after end of Normal Operating Season in which time was lost and at least 10 days before Termination Date. Contracting Officer shall make prompt written acknowledgment of such notice, indicating concurrence with the number of days in the notice or the number of days Forest Service considers as qualifying for the adjustment. Lost portions of days shall be disregarded in computing time lost. The three circumstances qualifying for a Contract Term Adjustment are:

  • 253 Design Change (a) “Design Change” is a change in work and/or materials shown in the Schedule of Items and described in Plans or specifications that has been mutually agreed to in writing or ordered by Contracting Officer. Changes of a minor nature (such as adjustment in horizontal and vertical alignment, that do not exceed specified tolerance, necessary to maintain or balance earthwork quantities substantially as designed) and variation in quantities, as described in B5.251, shall not be considered Design Changes.
