Accuracy of Information; Representations and Warranties. Any information contained in any financial statement, schedule, report or any other document delivered by Borrower, Guarantor or any other Person to Lender in connection with the Loan proves at any time not to be in all material respects true and accurate, or Borrower, Guarantor or any other Person shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in this Agreement or in any other Loan Document or other document, certificate or opinion delivered to Lender in connection with the Loan, proves at any time to be incorrect or misleading in any material respect either on the date when made or on the date when reaffirmed pursuant to the terms of this Agreement.

Any information contained in any financial statement, schedule, report or any other document delivered by Borrower to the County in connection with the AHIF Loan proves at any time not to be in all material respects true and accurate, or Borrower shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in the Loan Agreement or in any other AHIF Loan Document or other document, certificate or opinion delivered to County in connection with the AHIF Loan, proves at any time to be incorrect or misleading in any material respect either on the date when made or on the date when reaffirmed pursuant to the terms of the Loan Agreement.

Any information contained in any financial statement, schedule, report or any other document delivered by Borrower to the County in connection with the AHIF Loan proves at any time not to be in all material respects true and accurate, or Borrower shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in the Loan Agreement or in any other County Loan Document or other document, certificate or opinion delivered to County in connection with the County Loans, proves at any time to be incorrect or misleading in any material respect either on the date when made or on the date when reaffirmed pursuant to the terms of the Loan Agreement. Any such information, facts or documents must have a material adverse effect on the County Loan to constitute a default.

Any information contained in any financial statement, schedule, report or any other document delivered by Borrower, Guarantor or any other Person to Lender in connection with the Loan proves at any time not to be in all material respects true and accurate, or Borrower, Guarantor or any other Person shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in this Agreement or in any other Loan Document or other document, certificate or opinion delivered to Lender in connection with the Loan, proves at any time to be incorrect or misleading in any material respect either on the date when made or on the date when reaffirmed pursuant to the terms of this Agreement; provided that if such statement, representation or warranty was not knowingly or negligently false, misleading or erroneous, then Borrower shall have a thirty (30) day period in which to remedy the underlying condition which caused such statement, representation or warranty to be so false, misleading or erroneous.

Any information contained in any financial statement, schedule, report or any other document delivered by Borrower to the County Board in connection with the CDBG Loan proves at any time not to be in all material respects true and accurate, or Borrower shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in this Agreement or in any other CDBG Loan Document or other document, certificate or opinion delivered to County Board in connection with the CDBG Loan, proves at any time to be incorrect or misleading in any material respect either on the date when made or on the date when reaffirmed pursuant to the terms of this Agreement.

Any information contained in any financial statement, schedule, report or any other document delivered by Borrower, Guarantor or any other Person to Lender in connection with the Loan proves at any time not to be in all material respects true and accurate, or Borrower, Guarantor or any other Person shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in this Agreement or in any other Loan Document or other NPCHLT1:500113.7-TBF-(KMROCHEK) 900000-02386 document, certificate or opinion delivered to Lender in connection with the Loan, proves at any time to be incorrect or misleading in any material respect either on the date when made or on the date when reaffirmed pursuant to the terms of this Agreement.

Any information contained in any financial statement, schedule, report or any other document delivered by the Grantor or any other party or parties to the Beneficiary in connection with the Loans proves at any time to be not in all respects true and accurate, or the Grantor or any such other party or parties shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in this Deed of Trust, or in any other document, certificate or opinion delivered to the Beneficiary in connection with the Loans, proves at any time to be incorrect or misleading in any material respect. Section 6.02.
Accuracy of Information; Representations and Warranties. Borrower must satisfy Lender that no information, document, exhibit or report furnished to Lender by Borrower in connection with the negotiation or execution of the Loan Documents or in connection with Borrower's application for the Loan, and no report, statement or information required to be furnished by Borrower to Lender under the Loan Documents, has contained or will contain, any material misstatement of fact or omitted or will omit to state a material fact or any fact necessary to make any statement contained therein not misleading. Borrower must satisfy Lender that Borrower knows of no fact which is not disclosed in writing to Lender which may in the future have a material adverse effect on Borrower.

Any information contained in any financial statement, schedule, report or any other material document delivered by any Grantor or any other party or parties on behalf of any Grantor to the Beneficiary in connection with the Loan proves at any time to be not in all material respects true and accurate, as of the time made or any Grantor or any such other party or parties shall have failed to state any material fact or any fact necessary to make such information not misleading, or any representation or warranty contained in this Deed of Trust, including, but not limited to the representations set forth in Section 3.17 of this Deed of Trust, or in any other material document, certificate or opinion delivered by any Grantor to the Beneficiary in connection with the Loan, proves at any time to be incorrect or misleading in any material respect as of the time made.
