Absence. During any authorized leave of absence, a full-time employee shall maintain and accumulate seniority. Leave of absence in excess of thirty (30) calendar days will not be granted until a request for same is submitted in writing to attend both the Union conventionsand the Employer and mutually agreed upon. When an employee suffers an injury, courses whether on the job or not, or suffers any illness preventing him from reporting to work, he will automatically be granted leave of absence, without pay, and conferences subject to any payments the employee is entitled to under any Sick Pay Plan, until such time as his doctor states such employee can return to work, provided the Employer reserves the right to require the employee to be examined on the employee's return to work by a doctor selected by the Employer which examination shall be paid for by the Employer, Such absence will not exceed one (I)calendar year except by mutual consent of the parties, except for which will not exceed two (2) years. If an employee desires a leave of absence for reasons other than those referred to above, he must obtain permission in writing for the same from the Employer. However, all legitimate and reasonable requests will be approved in accordance in the best interest of the business and the employee. If the leave of absence is to extend a vacation, then it must be in accordance with Article (7.01). In any instance where an employee accepts other employment without the consent of the Employer, when on leave of absence or vacation for any reason, his employment may be terminated subject to proper proof of same. When an employee suffers any injury or illness which requires his absence, he shall report the absence to the Employer as soon as possible so adequate replacement may be made if necessary. Employees must keep the Employer notified of their correct address and phone number at all times. It is required that employees on sick leave advise the Employer as to his availability to return to work with as much advance notice as possible for scheduling purposes and preferably with a minimum of twenty-four (24) hours notice in advance of his availability. In case of death in the immediate family, the regular full-time employee and part- time employee affected shall be granted without compassionate leave of absence with pay for his scheduled hours to a maximum of eight (8) hours at his straight time hourly wage rate for each scheduled working day which may occur during a maximum three (3) day period. Immediate family means: spouse, parents or step-parents of employee and without loss of seniority provided that notice of spouse, children, sister or brother, sister-in-law, brother-in-law, grandchildren and grandparents. The employee must attend the funeral. Casual employees shall be paid prorated for attending a funeral as per the Canada Labour Code. For all above designated family members not listed in the Code, the Employee will be given one (1) week is given the Company, day. Absence. 6.01 Every employee shallwork as scheduled unless he has:
1. Asked for and been granted EXCUSED ABSENCE (a period of three (3) consecutiveworking days or less) or,
2. Made written application on the form provided by the Company and been granted a LEAVE OF ABSENCE (a period in excess of three (3) consecutiveworking days). 6.04 Leave of absence without pay may be granted, upon receipt of two (2) week's written notice, to not more than eight (8) employees who works at any one time for another employer as long as they are in full time attendance at a recognized Training Institute, in which their course of studies can directly furtherqualify them for work with the Company. In addition, upon receipt of one (1) weeks written notice, the Company will grant leave of absence without payto not more than two (2) employees at any one time to attend a regular course conducted by the Labour College of Canada.
6.05 Except as otherwise provided, an employee while on leave of absence shall not become entitled to or have creditedto him any benefitswhich arise out of this Agreement other1than his length of continuous service for the purpose of seniority.
6.06 An employee required to be absent from work to attend the funeral of his father, mother, wife, child, brother, sister, father-in-law, mother-in-law, brother-in-law.sister-in-law, grandparents or grandchild shall be granted a funeral leave for the time necessary for that purpose. For three (3) days of such leave he shall be paid for eight (8) hours at his straight time hourly rate. The above shall apply if the employee obtains leave of absence because of sickness in his immediatefamily and death occurs during such leave. These provisions will also apply if an employee is required to take leave of absence to care for his children at Wabush or its immediate area while his wife attends the funeral of one of the relativesspecified. Before such bereavement allowance is paid, the employee shall, if the Company so requests, provide evidence of attendance at the funeral.
6.07 An employeewho is elected as a member of the House of Assembly of Newfoundland or to the House of Commons will be deemed to have left the employ of Bakeries Limited. If an employee who has had granted a leave of absence within for a period equal to thetime that he continues as an elected member of either body. Such leave may be extended from term to term upon requestto the previous calendar year requests a Company.
6.08 Maternity leave of absence, other applicants absence will be granted to a female employee who has acquired seniority in his department the bargaining unit. Such leave of absence shall be given priority over himmandatory and may commence (4) months prior to the anticipated date of birth of the child (but not laterthan eleven (I) weeks beforethe anticipated date of birth) and shall terminate not later than four (4) months after the actual date of birth but not earlier than six (6) weeks after the actual date of birth. Such employee, upon return to work Will be restored to thejob she held at the commencement of leave of absence providing it is still available and she still qualifies in accordance with Artide 8.
6.09 An employee who is summoned to serve on a criminaljury or to atend court as a witness in a criminal or quasi-criminal case, will be paid an allowanceequal to the diference between the payment he received for each day of such service and the pay he would normally have received had he worked as scheduled on each day of such setfice. To qualify for such an allowance, an employee mustgive his ▇▇▇▇▇▇▇ at least three (3) days notice of his impending absence and later must provide the Company with Court documentationjustifying his absence forjury service or his attendance at court as a witness and verifying any payment he has received for jury service. The Union agrees foregoing provisions shall also apply where an employee is scheduled to co-operate work the midnightto 08 00 A. 7.01 An employee shall beconsidered probationaryfor a period ofsixty (60) days of actualwork. At the end of the probationary periodsuch employee's name shall be placed upon the seniority lists, where applicable, as of the date of commencement ofwork for the Company.
7.02 Duringthe period of probation, an employee has no seniority standing and the Company shall not be required to retain him in employment or to reemploy him in the event he is released and such shall not be subject to the grievance procedure.
7.03 If a probationary employee wishes to discuss a complaint with the Company, he may do so with or withoutthe assistance of a Grievance Committeeman. ARTICLES SENIORITY
8.01 Length of continuous service with the Company shall be determined by the date ofthe employee's first employment with the Company or the date of re-employment following tennination under the provisionsof Section 8:09 herein. On or afterthe date of execution ofthisAgreement, employees hired on the same day \\il be placed on seniority lists in preventing abuses the order of their hiring times during the day.
8.02 A. Except as providedfor in Sections BJ and C} following, length of continuous service in a job shall be detennined by the date of the foregoing leave employee's first day worked in the job following pennanent assignmentto thatjob. Absence. Leave During leave of absence or layoff, the Employer shall continue to payments on behalf of the employee to all Health and Welfare plans, for the first thirty (30) days. Seniority shall continue to accrue during any leave of absence or layoff. A. Employees unable to work on their scheduled workday must notify their supervisor, or party designated by the supervisor in the event that notice of one (1) week the supervisor is given the Companyunavailable, and provided that as soon as possible but, in any event, not more than three (3) employees are absent for such purpose at any one time. Leave of absence without pay and without loss of seniority for a period of up to three (3) months will be granted employees, provided that not more later than two (2) employees per department Breadhours in residential, Rolls, Shipping, Janitors, emergency services and Wrapping, transportation and not more than one (1)employee per department from Donuts1) hour in other areas before the time they would normally report to work on said date, Piesexcept in emergency situations, Garage, Maintenance and Receiving, may be absent for such purpose in which case employees must notify their supervisor at the same timefirst possible opportunity thereafter. B. When an employee is absent four (4) or more consecutive working days, the Center may require the employee furnish to the Center a written physician's statement indicating that the employee is able to return to work without limitation and without risk of further injury.
C. Absences from work other than in accordance with the terms of this Agreement shall be considered unauthorized. Such absences shall be charged to the employee’s available PTO unless specifically authorized otherwise by the terms of this Agreement.
D. The Center will give consideration to requests made by employees for a personal leave of absence not to exceed thirty (30) days in duration. No leave of absence shall normally be granted only to employees who have completed a an employee for the purpose of two (2) years of Company service. The employees concerned shall individually the Company at least four (4) weeks in advance of their scheduled date of departure. This accepting employment elsewhere.
E. Each application for leave of absence will be granted in addition to their regular vacation if requested. Employees who qualify for a leave shall set forth the purpose of absence can apply all of their vacation entitlement against the time required. Leave of absence for lesser period of time may be granted employees on compassionate grounds or for other legitimate personal reasons. Leaves of absence of this category shall be without pay and without loss of seniority, and shall normally be limited to a maximum of two (2) employees within the bargaining unit. Any employees who works for another employer while on leave of absence will be deemed to have left the employ of Bakeries Limited. If an employee who has had a leave of absence within the previous calendar year requests a leave of absence, other applicants the date on which the leave of absence is to start and the date the employee will return to work.
F. Each leave of absence granted shall be in his department writing and copies thereof shall be given priority over himto the Union and the employee.
G. During the period of absence, the employee shall not engage in gainful employment in any industry. The Union agrees Failure to co-operate comply with this provision, without first obtaining the Company in preventing abuses consent of the foregoing Center, shall result in the termination of the employee involved. In addition, falsification of the reason for a request for leave of absence provisionsshall be a cause for discharge.
H. An absence of an employee who fails to return to work on the day specified in the leave of absence without having received an extension thereof, unless said failure to obtain an extension is beyond the control of the employee, shall be deemed unauthorized. In the case when extensions are requested for leaves which are given for twenty (20) or more days, such extensions must be requested in writing at least two weeks prior to the expiration of the original leave.
Section 2. The Center may grant temporary leaves of absence for family/medical, military service educational advancement, or other compelling personal reasons. A leave of absence is any unpaid absence from work which exceeds fourteen (14) calendar days, and which has been properly requested and approved by the immediate supervisor, Service Director, Human Resource Department and Executive Director. The request for leave should be made at least fourteen (14) calendar days in advance of the anticipated starting date. A “Request for Family/Medical Leave” or a "Request for General Leave of Absence" form may be obtained from the Human Resource Department. Employees who accept other employment during their Leave of Absence shall be considered to have terminated their employment with the Center as of the date their leave became effective. Leaves of Absence are classified as follows, and are available to any regular employee who has successfully completed the probationary period and any other requirements for the specific leave requested.
