A Position. Vacancy Bulletin will not be required: (a) when a vacant or new position is to be filled on a temporary basis for a period of sixty (60) days or less; (b) when a sick leave absence is filled for up to six-hundred and forty (640) hours; (c) when a vacant or new position is to be filled by the recall of a laid-off employee, in accordance with Article 22 - ▇▇▇▇▇▇ and ▇▇▇▇▇▇; (d) when, upon Employer consultation with the Union, an employee is transferred to a vacant or new position for medical reasons; (e) when an employee is placed into a vacant or new position following his/ her return from sick leave or long-term illness and for medical reasons cannot return to his/her former position, or his/her former position has been filled; or his/her former position has been abolished; or (f) when, upon Employer consultation with the Union, an employee is transferred to a vacant or new position by reason of “duty to accommodate”, as per the Human Rights Code of Manitoba. (g) when an employee within the same classification requests a transfer in writing, subject to management approval, and as per the transfer opportunity process outlined within this article; (h) when a candidate has been in the classification on a temporary assignment as a result of a posted competition for twelve (12) consecutive months or more with satisfactory work performance and attendance they may be appointed should the temporary assignment become a permanent vacancy; (i) when, upon consultation with the Union, the Employer wishes to transfer for developmental purposes or when operational changes/requirements provides for the transfer of staff within a specific classification.
A Position. No member of the bargaining unit will bid on a posting unless the member will report to work in the new position if successful in the bidding process. This shall not apply where the employee has the opportunity to bid on a position with more hours, a higher rate of pay, a permanent position, or can relocate to a closer to their residence, and is successful in their bid. Should an employee be successful in their bid, but not report due to one of the above situations, the Board may then offer the next qualified applicant from the original posting, as a temporary position, without reposting the position. The temporary appointment would last until the successful applicant reports to the new positions. All promotions, transfers, demotions shall be subject to a trial period of working days. Conditional on satisfactory service, such trial promotion shall become permanent after the period of working days. In the event the successful applicant proves unsatisfactory in the position or if the employee wishes for valid reasons, will be returned to his or her former position at the prevailing rate without loss of seniority and any other employees promoted or transferred because of the rearrangement of positions shall if necessary be returned to their former position. In the event an employee reverts back to the employees former position the vacant position may be awarded to the next senior qualified person on the list of original employee applications or may be reposted. This section shall not apply to temporary replacements of eight (8) weeks or less necessitated by illness, injury, or leave of absence, or replacement of employees on vacation or for temporary filling of vacancies. In the event that a temporary replacement exceeds the eight (8) week stipulation above, then the position shall be posted. If extenuating circumstances exist the eight (8) week period may be extended with mutual agreement.   • Term Position A position occupied by a full-time or part-time nurse for a specified period of time, up to a maximum of sixty (60) weeks, where patient/client/resident census or workload necessitates a temporary increase in staffing, if mutually agreed, to replace a nurse(s) who is/are on vacation or leave of absence, or to carry out a special short term project or where the Employer has provided notice of permanent deletion of position(s) under the Memorandum of Understanding regarding Employment Security, or as otherwise mutually agreed between the Union and the Employer. If the Employer determines there is a term position to be filled by a nurse, the term position shall be posted in accordance with Article 30.   • New Positions The Board, in consultation with the Association, shall prepare a new job description whenever a new position of special responsibility is created or whenever the duties of any such position are changed or increased. When such a position is created or changed, the allowance shall be subject to negotiations between the Board and the Association.

  • Filling Positions ‌ The Employer will determine when a position will be filled, the type of appointment to be used when filling the position, and the skills and abilities necessary to perform the duties of the specific position within a job classification. Only those candidates who have the position-specific skills and abilities required to perform the duties of the vacant position will be referred for further consideration by the employing agency. A. An agency’s internal layoff list will consist of employees who have elected to place their name on the layoff list through Article 34, Layoff and Recall, of this Agreement and are confined to each individual agency. Up to seventy-five percent (75%) of those candidates will be statewide layoff, agency promotional, internal transfers, and agency voluntary demotions.
