JURISDICTION. 23. For all matters concerning the interpretation and performance of this agreement, the parties expressly declare their consent to submit to the judges and courts of Mexico City, as well as to the legal provisions of the current Civil Code in force in Mexico City, waiving the jurisdiction of any other Court corresponding to their present or future addresses.
JURISDICTION. Any controversy over the Contract will be resolved by the competent judge of the Republic of Colombia. This clause is for the exclusive benefit of the Bank and does not prevent the Bank from bringing proceedings before the courts of any other country or state with jurisdiction, including to the extent permitted by law, concurrently with any number of countries and states. 17.
JURISDICTION. To the extent permitted by law, the parties, with express waiver of any other jurisdiction to which they might have recourse, agree to submit to the jurisdiction of the Regional Community of Valencia. SIXTEENTH. SUSPENSION AND TERMINATION CAUSES 16.1. - Ordinary. The agreement terminates upon completion of the Clinical Trial. 16.2.-Extraordinary.- This contract may be cancelled or terminated in the event that any of the causes stated in section 2 of article 59 of Law 29/2006, of July 26 on the Guarantees and Rational Use of Medicines and Health Products concur. Morover, it may be terminated or modified for the following causes: •Failure to include a minimum number of patients that allow the final assessment of the trial in a reasonable time. •Duly justified cause • If the total number of patients to be included in the trial by different Investigators participating in the same in competitive and multi-center trial is achieved In case of cancelation or early termination of the contract, the Sponsor will pay only the amount corresponding to the work effectively carried out of the number of visits made to patients evaluable so far. Once el trial is suspended or terminated, the Principal Investigator and/or the Centre shall return to the Sponsor the supplied material and any unused medication in their possession. 16.3. -
JURISDICTION. The parties expressly submit themselves to the Jurisdiction of the Courts sitting Xxx Xxxx Xxxxxx, State of San Xxxx Potosi, Mexico for the interpretation, execution and enforcement of this document and the Purchase Order, expressly waiving to any other jurisdiction that by reason of their present of future domiciles, or because of any other cause, the parties may be entitled to. This Purchase Order shall be governed by the laws of the United Mexican States. If Supplier fails to perform any of its obligations, Supplier shall pay Buyer all costs and expenses incurred by Xxxxx, including all attorneys’ fees, in enforcing Buyer’s rights, whether by formal proceedings or otherwise, in addition to any other remedy available to Buyer. Under no circumstances the provisions included in the United Nations Convention on Contracts for the International Sale of Goods will be enforceable to this Purchase Order.
JURISDICTION. The place of jurisdiction for any disputes about or arising from this contract is Bangalore.
JURISDICTION. The parties submit, waiving any other jurisdiction to which they might have recourse, to the Jurisdiction of the Courts and Tribunals of the city of Valencia. EIGHTEEN. - DISCONTINUATION AND TERMINATION CAUSES. The following will be termination causes: 18.1- Ordinary. The contract shall be terminated when the clinical trial has been completed. 18.2.-Extraordinary. This Contract may be suspended or terminated in any of the instances set forth in paragraph 2 of Article 59 of Royal Legislative Decree 1/2015, of July 24, approving the revised Law on guarantees and rational use of medications and health care products, or in any of the following instances: Impossibility of enrolling the minimum number of patients to permit final assessment of the trial within a reasonable deadline. Due to duly justified causes. If the total number of patients who must be enrolled in the trial is reached by the various investigators who participate in the trial when it is a multi-center competitive one. In case of early discontinuation or termination of the contract, the Sponsor shall solely pay the relevant amount for the work undertaken based on the number of visits paid by the evaluable patients until then. In case of discontinuation or termination of the trial, the Principal Investigator and/or the Site shall return the material supplied and all the unused medication still in their custody. 18.3.-
JURISDICTION. If the Parties fail to reach an agreement on the Dispute or, if applicable, on the procedure for its out-of-court resolution within three months, the Dispute may be subject to the jurisdiction of the Courts and Tribunals of the city of Barcelona, to whose competence the Parties hereby expressly, clearly and definitively submit. JURISDICTION. In case of any suit or other legal proceedings arising under or relating to the rate contract, the courts at Haridwar only shall have jurisdiction.
JURISDICTION. The parties shall endeavor to amicably settle any issues that may arise as a result of the interpretation of or compliance with this contract. In the event that the parties are unable to settle their differences otherwise, they shall submit themselves to the jurisdiction and competence of the Courts and Tribunals of Xxxxxxxx / Xxx Xxxxxxxxx [Spain], expressly waiving any other jurisdiction that may correspond to them.
JURISDICTION. The place of jurisdiction for any disputes about or arising from this contract is Montreal.
