Unused Capacity Fee definition

Unused Capacity Fee has the meaning given in Clause 10.9.
Unused Capacity Fee means, for any month after the First Anniversary, an amount equal to the product obtained by multiplying: (i) 1/12 by (ii) 12.5 basis points by (iii) the Unused Capacity for such month.
Unused Capacity Fee means for any month in which Unused Capacity is permitted, an amount equal to the product obtained by multiplying: (i) 1/12, by (ii) 20 basis points (0.20%), by (iii) the Unused Capacity. The Unused Capacity Fee shall be paid monthly in arrears pursuant to the terms of Section 10.01.

  • Subject to the terms, conditions and limitations of this agreement, Borrower may re-borrow any part of the Fixed Advance which it has previously borrowed and repaid unless Borrower has terminated the Variable Facility Commitment as set forth in Section 5.04 and provided that Borrower is paying the Unused Capacity Fee set forth in Section 10.01.

  • Prepayment of a Bond Loan and any related Advance shall result in a permanent reduction in the Commitment by an amount equal to such payment and require payment of a Termination Fee unless Borrower elects to maintain such amount as Unused Capacity and pays an Unused Capacity Fee with respect thereto in accordance with Section 10.01.

  • At all times that Borrower desires to maintain the availability of Unused Capacity, Borrower shall pay the Unused Capacity Fee which shall enable Borrower to borrow the remainder of the Commitment subject to the terms of this Agreement.

  • Basis for retirement coverage of civil servants and its order shall be determined by relevant Law of the Republic of Azerbaijan with consideration of provisions of this article.

  • Bonus Shares means the shares in respect of the Shares held by the Trustee on behalf of a Participant issued as part of a bonus issue to security holders of NIGL.

  • Borrower shall pay the Unused Capacity Fee to Lender for the period from the First Anniversary to the end of the Term of this Agreement.

Related to Unused Capacity Fee

  • Committed Capacity means that portion of the Capacity that is required to meet the Capacity Entitlements of Access Holders;

  • Available RP Capacity Amount means (i) the amount of Restricted Payments that may be made at the time of determination pursuant to Sections 7.06(d), (g), (h) and (l) minus (ii) the sum of the amount of the Available RP Capacity Amount utilized by the Borrower or any Restricted Subsidiary to (A) make Restricted Payments in reliance on Sections 7.06 (g), (h) or (l), (B) incur Liens pursuant to Section 7.01(bb), (C) make Investments pursuant to Section 7.02(n), (D) incur Indebtedness pursuant to Section 7.03(y) and (E) make prepayments, redemptions, purchases, defeasances and other payments in respect of Junior Financings prior to their scheduled maturity utilizing the Available RP Capacity Amount pursuant to Section 7.13 plus (iii) the aggregate principal amount of Indebtedness prepaid prior to or substantially concurrently at such time, solely to the extent such Indebtedness (A) was secured by Liens pursuant to Section 7.01(bb) or (B) was incurred pursuant to Section 7.03(y) and not secured pursuant to Section 7.01(bb) (it being understood that the amount under this clause (iii) shall only be available for use under Sections 7.01(bb) and/or 7.03(y), as applicable).

  • Reserved Capacity means the maximum amount of capacity and energy that the Transmission Provider agrees to transmit for the Transmission Customer over the Transmission Provider’s Transmission System between the Point(s) of Receipt and the Point(s) of Delivery under Tariff, Part II. Reserved Capacity shall be expressed in terms of whole megawatts on a sixty (60) minute interval (commencing on the clock hour) basis.

  • Rated Capacity means the Average Daily Flow for which the Works are approved to handle;

  • Installed Capacity or 'IC’ means the summation of the name plate capacities of all the units of the generating station or the capacity of the generating station (reckoned at the generator terminals), approved by the Commission from time to time;

  • Unused Commitment Fee Rate has the meaning given to such term in the Fee Letter.

  • Nominal Rated Capability means the nominal maximum rated capability in megawatts of a Transmission Interconnection Customer’s Customer Facility or the nominal increase in transmission capability in megawatts of the Transmission System resulting from the interconnection or addition of a Transmission Interconnection Customer’s Customer Facility, as determined in accordance with pertinent Applicable Standards and specified in the Interconnection Service Agreement.

  • Applicable Unused Commitment Fee Rate means 0.50% per annum.

  • Applicable Facility Fee Rate means, at any time, the percentage rate per annum at which Facility Fees are accruing on the Aggregate Commitment (without regard to usage) at such time as set forth in the Pricing Schedule.

  • Maximum Capacity or ‘Pmax’ means the maximum continuous active power which a power-generating module can produce, less any demand associated solely with facilitating the operation of that power-generating module and not fed into the network as specified in the connection agreement or as agreed between the relevant system operator and the power-generating facility owner;

  • Unused Facility Fee has the meaning specified in Section 2.09(a).

  • Licensed capacity means the number of children the Department has determined the day care home can care for at any one time in addition to any children living in the home who are under the age of 12 years. Children age 12 and over on the premises are not considered in determining licensed capacity.

  • Utilization Fee Rate means the percentage set forth in Schedule 1 hereto beside the then applicable Level.

  • Available Capacity means the capacity from the Project, expressed in whole megawatts, that is available to generate Product. [For As-Available Product facilities only]

  • Contracted Capacity means the capacity (in MW AC) contracted with MSEDCL for supply by the successful bidder at the Delivery Point from the Solar Power Project.

  • Bid Capacity meanss capacity offered by the bidder in his Bid under invitation.

  • Facility Fee Rate means a rate per annum determined in accordance with the Pricing Schedule.

  • Applicable Facility Fee Percentage means, as at any date of determination, the rate per annum then applicable in the determination of the amount payable under Section 2.14(C)(i) hereof determined in accordance with the provisions of Section 2.14(D)(ii) hereof.
