If a contractor fails to disclose facts pertaining to the existence of a potential or actual PCOI or misrepresents relevant information to the State, the State may terminate the contract for default or pursue such other remedies as may be permitted by law or this contract.
If after termination by the State, the State agrees that Contractor was not in breach or that Contractor's action or inaction was excusable, such termination shall be treated as a termination in the public interest, and the rights and obligations of the Parties shall be as if this Participating Addendum had been terminated in the public interest under §3.
In addition to other remedies and options available to the State, the State may issue one or more notices to the vendor outlining any issues the State has regarding the vendor’s performance for a specific contract (“Contract Compliance Request”).

If the final cost of the State participation construction exceeds the amount of funds advanced by the State, the State will pay the difference to the City without interest.
In limited circumstances, such as ongoing litigation of a project funded under the grant agreement between the FAA and the State, the State may request one PoP extension in accordance with 2 CFR Part 200.
In the event that a State receives a request seeking disclosure of any of the Reports or supporting information described in this Settlement Agreement and believes that such information is subject to disclosure under the relevant laws of that State, the State agrees to provide Google with at least thirty (30) days advance notice before producing the information, if permitted by the State’s laws.
