Sexual conduct is defined as: any verbal or physical or other conduct that is sexual in nature; directed toward a kindergarten through 12 student; unreasonably interferes with a student’s educational performance; and create an intimidating, hostile or offensive educational environment.
Sexual conduct does not include touching that is necessitated by the nature of the school employee's job duties or by the services required to be provided by the contractor, agent or volunteer and for which there is no sexual intent.
Sexual conduct where submission to, or rejection of, such conduct affects terms or conditions of employment; that substantially interferes with an employee’s ability to perform the job; or that creates a hostile work environment as described in County Policy.
