Remote Deposition means any deposition by oral examination conducted pursuant to Rule 3.33 of the Part 3 Rules of Practice where fewer than all of the participants— including Deposing Counsel, Defending Counsel, Attending Counsel, the Witness, court reporters, or videographers—are physically present in the same location at the time the deposition is taken. A “Remote Deposition” is a deposition conducted on the Platform, which will allow for Deposing Counsel, Defending Counsel, Attending Counsel, the Witness, court reporters, and videographers to participate without attending the deposition in person or by other means to which the Parties may agree for a particular deposition or Witness.
Remote Deposition means any deposition by oral examination taken in this case for the purposes of discovery pursuant to Rule 3.31A or 3.33 of the Part 3 Rules of Practice where fewer than all of the participants—including Deposing Counsel, Defending Counsel, the Witness, or the Court Reporter — are physically present in the same location at the time the deposition is taken but instead participate by means of the Platform.

Examples of Remote Deposition in a sentence

  • At the beginning of the Remote Deposition, every person logged onto the Platform or otherwise viewing or listening to the deposition must be identified for the record.

  • In addition, to prevent confidential documents from being downloaded by witnesses, electronic exhibits may only be shared with the witness through the Remote Deposition Technology via a hyperlink to file sharing software (to be agreed upon in advance) with the download function disabled.

  • These security measures include using tools such as a “virtual waiting room” that allows the court reporter to admit only individuals authorized to attend the deposition and disabling the “record” feature in the Remote Deposition Technology for the witness and attending attorneys.

  • Nothing in this paragraph is meant to preclude Defending Counsel who represents a Witness and is physically located in the same room as the Witness during the Remote Deposition from providing a hard copy of an exhibit that has been introduced to the Witness, provided that doing so does not unreasonably delay the Remote Deposition.

  • All persons attending depositions taken pursuant to this Remote Deposition Protocol who do not have an immediate need to speak shall ensure that their telephone or video conference lines are muted.

  • The Parties hereby expressly waive all objections to any Remote Deposition, and the admissibility of any testimony given during a Remote Deposition, based solely on the fact it was a Remote Deposition.

  • If technical difficulties arise during the taking of a Remote Deposition, counsel for the Parties must meet and confer immediately, by telephone or other means, to determine whether the Remote Deposition can proceed or should be continued to a future date.

  • The Noticing Party shall serve a copy of this Protocol with any subpoena for a Remote Deposition.

  • The Parties agree not to oppose reasonable accommodations to allow such conferences during breaks, as well as communications among co-counsel during the Remote Deposition.

  • If the Platform for a Remote Deposition does not permit the court reporter to mark exhibits remotely, Deposing Counsel shall be responsible for marking exhibits and ensuring that such marks are communicated to the court reporter and all participating attorneys on the record during the Remote Deposition.

  • Remote Terminal or "RT" means a cabinet, vault or similar structure at an intermediate point between the End User Customer and CenturyLink's Central Office, where Loops are aggregated and hauled to the Central Office or Serving Wire Center using LCM. A Remote Terminal may contain active electronics such as digital loop carriers, fiber hubs, DSLAMs, etc.

  • Experimental or Investigative means treatments, devices or prescription medications which are recommended by a Physician, but are not considered by the medical community as a whole to be safe and effective for the condition for which the treatments, devices or prescription medications are being used. This includes any treatments, procedures, facilities, equipment, drugs, drug usage, devices, or supplies not recognized as accepted medical practice, and any of those items requiring federal or other governmental agency approval not received at the time services are rendered.
