Qualifying Damage definition

Qualifying Damage means cracking, bowing, shrinking, warping, breakage, or gapping (greater than 3/16”) in the Siding and, if available, property damage resulting from such failed Siding, including damage under the weather barrier.
Qualifying Damage means the following conditions:
Qualifying Damage to Siding means damage caused by a defect in the Siding that is manifested as shrinkage between the ends of Siding in excess of 3/16” except that for Siding installed abutting windows, doors or trim, shrinkage must exceed 5/16”. In addition, Siding with warping or bowing in excess of 1/2”, field and edge cracking through the board, or delamination is also Qualifying Damage.

Examples of Qualifying Damage in a sentence

  • If Specified Fleet believes it has a claim for Qualifying Damage, Specified Fleet will send written notice of such claim to Chevron as soon as reasonably practicable after becoming aware of such claim.

  • The vehicle with a claim for Qualifying Damage is owned by, and has been in the continuous possession of, Specified Fleet that was approved by Chevron and that entered into this Agreement.

  • Before submitting a claim for indemnification under this Agreement, Specified Fleet must have filed and pursued such claim under the warranty provided by the manufacturer of the Covered Vehicle Engine, and such manufacturer must have reasonably determined that the sole cause of the Qualifying Damage is the lubricant that was used.

  • Subject to the terms of this Agreement, Chevron’s obligations hereunder with respect to all claim of Qualifying Damage outstanding as of the date of termination will survive termination of this Agreement until resolved in accordance with the terms hereof.


More Definitions of Qualifying Damage

Qualifying Damage means the cost of parts and labor to repair any direct damage to a Covered Vehicle Engine where such damage was caused directly by Specified Fleet’s use of Delo 400 ZFA 10W-30 in such Covered Vehicle Engine operated under designated conditions and maintained in accordance with the vehicle manufacturer’s drain recommendations; provided that Qualifying Damage shall not include:
Qualifying Damage means Splitting, Warping, Swelling, Shrinking, or Surface Decay. “Qualifying Damage” to any portion of a continuous piece of a board, fascia, or handrail will be deemed “Qualifying Damage” to the entire piece.
Qualifying Damage to Siding means damage caused by a defect in the Siding that is manifested as shrinkage between the ends of Siding in excess of 3/16” except that for Siding installed abutting windows, doors or trim, shrinkage must exceed 5/16”. In addition, Siding with warping, buckling or bowing in excess of 1/2”, field and edge cracking through the board, or delamination is also Qualifying Damage.
Qualifying Damage shall have the meaning set forth in Paragraph 12.1.
Qualifying Damage has the meaning given to it in Section 6.3(e).

Related to Qualifying Damage

  • Qualifying Event means, during the Participant’s Services with the Company and its Affiliates, the Participant’s death or Disability.

  • Qualifying Offer shall have the meaning set forth in Section 11(a)(ii) hereof.

  • Qualifying Facility means an electric energy generating facility that complies with the qualifying facility definition established by PURPA and any FERC rules as amended from time to time (18 Code of Federal Regulations Part 292, Section 292.203 et seq.) implementing PURPA and, to the extent required to obtain or maintain Qualifying Facility status, is self-certified as a Qualifying Facility or is certified as a Qualified Facility by the FERC.

  • Qualifying Time Period means the period defined in Section 2.3.C, during which the Applicant shall make investment on the Land where the Qualified Property is located in the amount required by the Act, the Comptroller’s Rules, and this Agreement.
