Privately owned waters definition

Privately owned waters means any surface waters confined within the boundary of privately owned land and which do not flow into, or do not communicate with:
Privately owned waters means waters confined within an artificial containment, such as man-made ponds, vats, tanks, raceways and any other indoor or outdoor facility constructed wholly within or on the en- closed land of an owner or lessor.
Privately owned waters means artificial reservoirs or enclosures located on privately owned property and shall be constructed so as to prevent at all times the ingress and egress of fish life from public waters, and such reservoirs or enclosures located on privately owned property shall not include lands of natural streams or natural lake beds.

  • Publicly Owned Treatment Works (POTW means a treatment works as defined by § 212 of the CWA, which is owned by a state or municipality (as defined by § 502(4) of the CWA). This definition includes any devices and systems used in the storage, treatment, recycling, and reclamation of municipal sewage or industrial wastes of a liquid nature. It also includes sewers, pipes, and other conveyances only if they convey wastewater to a POTW treatment plant. The term also means the municipality as defined in § 502(4) of the CWA, which has jurisdiction over the indirect discharges to and the discharges from such a treatment works.
