Power of Decision definition

Power of Decision means a power or right, conferred by or under this By-law and the Administrative Penalty By-law, to make a decision deciding or prescribing the legal rights, powers, privileges, immunities, duties or liabilities of any Person:
Power of Decision means a power or right, conferred by or under this By-law, to make a decision deciding or prescribing, the legal rights, powers, privileges, immunities, duties or liabilities of a Person;(a)in the case of a Screening Officer, in respect of a request to review anAdministrative Monetary Penalty;(b) in the case of a Hearings Officer, in respect of a request to review a Screening Decision;
Power of Decision means a power or right, conferred by or under the Administrative Monetary Penalty By-law, to make a decision about or prescribing the legal rights, powers, privileges, immunities, duties or liability of any Person;

Examples of Power of Decision in a sentence

  • No person shall attempt, directly or indirectly, to communicate for the purpose of influencing a Screening Officer or a Hearing Officer respecting the determination of a matter respecting a Delegated Power of Decision in a proceeding that is or will be pending before such officers, except the Contravener who is entitled to be heard in the proceeding, or the Contravener’s authorized agent, and only during the screening or hearing of the proceeding relating to the matter.

  • The position of Hearings Officer is established for the purpose of exercising the Power of Decision in the review of a Screening Decision in accordance with this By-law and the Regulation.

  • The position of Screening Officer is established for the purpose of exercising the Power of Decision in the review of an Administrative Monetary Penalty in accordance with this By-law and the Regulation.

  • The position of Screening Officer is established for the purpose of exercising a Power of Decision in the review of an Administrative Penalty in accordance with the City’s Administrative Penalty By-law.

  • The position of Hearings Officer is established for the purpose of exercising the Power of Decision in the appeal of a Screening Decision as set out in the City’s Administrative Penalty By-law.

  • The SPA does note that there must be a “Plan of care in effect which requires regular direct or client-related contacts or communication or activity with the client, family, service providers, significant others and others including at least one face-to-face contact every 90-days.”It was explained that any individual with ID can get case management services but that the intensity of the involvement of the case manager differs for individuals enrolled on the waiver.

Related to Power of Decision

  • Decision means a determination, action, vote, or disposition upon a motion, proposal, recommendation, resolution, order, ordinance, bill, or measure on which a vote by members of a public body is required and by which a public body effectuates or formulates public policy.

  • Tour of Duty means the period of time, not exceeding the basic hours of work per day, which an employee is scheduled to work on any day, and of which she has been advised in advance.

  • Disciplinary Action means any action that can be taken on the completion of / during the investigation proceedings including but not limiting to a warning, imposition of fine, suspension from official duties or any such action as is deemed to be fit considering the gravity of the matter.
