Nonconsensual Sexual Penetration definition

Nonconsensual Sexual Penetration means Sexual Penetration, however slight, performed upon another person that occurs without that person’s Consent. “Sexual Penetration” means penetration of a vagina or anus by a penis, object, tongue, finger, or other body part; or contact between the mouth of one person and the genitals or anus of another person.
Nonconsensual Sexual Penetration means the penetration, no matter how slight, of the vagina or anus, with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.
Nonconsensual Sexual Penetration means the sexual penetration of any bodily opening with any object or body part without Consent. This could be committed by force, threat, intimidation, or through exploitation of another’s mental or physical condition (such as lack of consciousness, incapacitation due to drugs or alcohol, age, or disability) of which the Respondent was actually aware or which a reasonable person in the Respondent’s position should have been aware. Nonconsensual Sexual Penetration is a form of Sexual Misconduct.
