NEPA Determination definition

NEPA Determination means the [Finding of No Significant Impact][Categorical Exclusion][Record of Decision] for the Project issued by [insert name of appropriate USDOT modal agency field office] on [___], 20[__] in accordance with NEPA.

NEPA Determination means (a) with respect to the Eligible Projects that are designated as of the Effective Date, the Finding of No Significant Impact issued by EPA on March 4, 2021 in accordance with NEPA and (b) with respect to any Additional Eligible Project or Replacement Eligible Project proposed by the Borrower pursuant to Section 14(q) (Affirmative Covenants – Additional and Replacement WIFIA Participant Loans), a Finding of No Significant Impact or other final environmental determination for such Replacement Eligible Project issued by EPA in accordance with NEPA at the time such Additional Eligible Project or Replacement Project is listed in Schedule II (WIFIA Participant Loans and Eligible Projects).
