Long Beach Berth Throughput Agreement definition

Long Beach Berth Throughput Agreement means that certain Long Beach Berth Throughput Agreement dated as of the date hereof among Xxxxxx Xxxxx, TRMC, General Partner, Partnership and Operator, as such agreement may be amended, restated, modified or supplemented from time to time.

  • If any action is taken or threatened to declare these services a public use, then, upon notifying TRMC, Operator may (i) restructure and restate this Agreement, provided that such restructuring and restatement does not increase the charges that TRMC is obligated to pay or prevent TRMC from meeting its minimum throughput volume obligations under the Long Beach Berth Throughput Agreement, or (ii) terminate this Agreement upon thirty (30) days’ prior written notice.

  • A business combination as per IFRS 3 did not occur for either of the two newly consolidated companies, as the definition of a business according to IFRS 3 was not met.

  • Transmission Service Agreement or “TSA” shall mean the agreement entered into between Long Term Transmission Customer(s) and the TSP pursuant to which TSP shall build, own, operate and maintain the Project and make available the assets of the Project to Long Term Transmission Customer(s) on a commercial basis;

Ltd. and the Mount Xxxxxx and Mount Goldsworthy Mining Associates Joint Venturers in a form approved by the Minister in relation to the supply of water for, inter alia, the Joint Venturers’ water requirements for the purposes of this Agreement at Port Hedland;
