House Mark definition

House Mark means (a) the “KELLOGG’S” Trademark, (b) the “KELLOGG” Trademark, (c) the stylized, red logo of (a) and (b), (d) the stylized, red “K” Trademark, and (e) any acronyms, translations, transliterations, derivations, stylized versions, or variations of any of the foregoing or that are confusingly similar thereto.
House Mark means “NCR”.
House Mark means the trademark that a Party uses to identify its commercial operations.

Examples of House Mark in a sentence

  • If WKKC does not respond to a Media Inquiry Notice by the deadline provided in such Media Inquiry Notice which would result in ▇▇▇▇▇▇▇▇▇ missing a media inquiry deadline or would negatively impact the goodwill or reputation of the House Mark, then ▇▇▇▇▇▇▇▇▇ shall have the right to exercise reasonable business judgement in responding to the applicable media inquiry about the House Mark without feedback from WKKC.

  • The Licensed Marks (including for further clarity, the House Mark) and all rights therein and thereto are and shall remain owned (and for further clarity, as between the Parties and their respective Affiliates, exclusively) by NCR and its Affiliates, as the case may be.

  • NCR covenants for a period of three (3) years immediately following the Effective Date, that neither NCR nor any of its Affiliates shall use the House Mark within or for the Prohibited ATMCo Business (including with respect to any Solutions or Natural Evolutions thereof).

  • Without limitation to the foregoing, any cessation of use of the House Mark that requires approval by a Governmental Authority shall be expeditiously assembled, submitted, and diligently prosecuted for approval by the applicable Governmental Authority in a timely fashion by the Party (or an Affiliate of such Party) seeking approval (and shall be subject to receipt of such approval).

  • Notwithstanding the preceding sentence and for further clarity, (A) such license does not extend to use of the House Mark in the ATMCo Excluded Fields, and (B) such license shall only be exclusive with respect to or in the ▇▇▇▇▇ ▇▇▇▇▇▇ as of the Effective Date (which for further clarity shall not apply to any Natural Evolutions thereof), except as otherwise specified in Schedule 2.

  • Notwithstanding the preceding sentence, such termination shall only be in part with respect to (i) the relevant Licensed Marks, if such breach relates to particular Licensed Marks which do not use or include the House Mark, or (ii) all Licensed Marks that use or include the House Mark, if such breach relates to Licensed Marks that use or include the House Marks.

  • NCR and its Affiliates covenant to abide by the exclusivity provided by the License to ATMCo and its Affiliates and shall not use the House Mark in the ▇▇▇▇▇ ▇▇▇▇▇▇ as of the Effective Date (which for further clarity shall not apply to any Natural Evolutions thereof).

  • ATMCo covenants for a period of three (3) years immediately following the Effective Date, that neither ATMCo nor any of its Affiliates shall use the House Mark within or for the Prohibited NCR Business (including with respect to any Solutions or Natural Evolutions thereof).

  • In the event that NCR, its Affiliates, and its licensees (other than ATMCo, its Affiliates, and their sublicensees) determine that none of them will use, going forward, (i) the House Mark in any manner, or (ii) any of the Shared Product Marks that do not use or include a House Mark in any manner, NCR shall promptly notify ATMCo in writing of such determination.

  • Each Party shall inform the other Party of any instances of actual consumer confusion is becomes aware of regarding the use of the Licensed Marks (including the House Mark).

Related to House Mark

  • Service mark means a word, name, symbol, or device or any combination of a word, name, symbol, or device, used by a person to identify services and to distinguish the services of that person, including a unique service, from the services of others, and to indicate the source of the services, even if that source is unknown. Titles, character names used by a person, and other distinctive features of radio or television programs may be registered as service marks notwithstanding that they, or the programs, may advertise the goods of a sponsor.

  • Product Marks shall have the meaning set forth in Section 8.4.

  • Product Trademark has the meaning set forth in Section 8.8.1.

  • Product Trademarks means the Trademark(s) to be used by AbbVie or its Affiliates or its or their respective Sublicensees for the Development or Commercialization of Licensed Products in the Territory and any registrations thereof or any pending applications relating thereto in the Territory (excluding, in any event, any trademarks, service marks, names or logos that include any corporate name or logo of the Parties or their Affiliates).

  • collective mark means any visible sign designated as such in the application for registration and capable of distinguishing the origin or any other common characteristic, including the quality, of goods or services of different enterprises which use the sign under the control of the registered owner of the collective mark;
