Product Trademarks definition

Product Trademarks means all proprietary names or designations, trademarks, service marks, trade names, and brand names, including registrations and applications for registration therefor (and all renewals, modifications, and extensions thereof) and all common law rights, and the goodwill symbolized thereby and associated therewith, for a Product.
Product Trademarks means the Trademark(s) to be used by Adapt or its Affiliates or its or their respective Sublicensees for the Commercialization of Products and any registrations thereof or any pending applications relating thereto (excluding, in any event, any trademarks, service marks, names or logos that include any corporate name or logo of the Parties or their Affiliates).
Product Trademarks means the Trademark(s) to be used or that are used by Licensee or its Affiliates for the Commercialization of the Licensed Products in the Field in the Territory and any registrations thereof or any pending applications relating thereto in the Territory (excluding, in any event, any Trademarks that include any corporate name or logo of the Parties or their Affiliates).

Examples of Product Trademarks in a sentence

  • The JCC shall have the responsibility for identifying appropriate trademarks for use in the Commercialization of Products (excluding any Amylin or Lilly corporate trademarks or trade names, the "PRODUCT TRADEMARKS"), using an approach similar to and no less rigorous than that used by each Party in identifying trademarks for its own pharmaceutical products, which Product Trademarks must be approved by both Parties, such approval to not be unreasonably withheld.

  • Nippon Kayaku shall own all right, title, and interest in and to the Product Trademarks other than the Licensed Trademarks, and shall be responsible for the registration, prosecution, maintenance and enforcement thereof.

  • Subject to any limitations set forth herein, Sublicensee shall own all right, title, and interest to the Licensed Product Trademarks in the Territory, and shall be responsible for the registration, prosecution, and maintenance thereof.

  • All costs and expenses of registering, prosecuting, and maintaining the Licensed Product Trademarks shall be borne solely by Sublicensee.


More Definitions of Product Trademarks

Product Trademarks means the trademarks, service marks, accompanying logos, trade dress and indicia of origin used in connection with the distribution, marketing, Promotion and sale of each Licensed Product in the Territory. For purposes of clarity, the term Product Trademarks shall not include the corporate names and logos of either Party and shall include any internet domain names incorporating such Product Trademarks.
Product Trademarks means the Trademarks used or to be used by Licensee or its Affiliates or its or their Sublicensees for the commercialization of Licensed Products in the Territory (excluding, in any event, any Corporate Names and any other Trademarks that consist of or include any corporate name or corporate logo of either Party or any of its Affiliates or its or their (sub)licensees (or Sublicensees)).
Product Trademarks means the (i) any trademarks relating to a Co-Promoted Product and the registrations thereof, (ii) any pending or future trademark registration applications relating to a Co-Promoted Product, (iii) any unregistered trademark rights relating to a Co-Promoted Product as may exist through use prior to or as of the date hereof, (iv) any current or future modifications or variants of any of the foregoing trademarks, and (v) any future trademarks adopted by AstraZeneca or its Affiliates for use in connection with a Co-Promoted Product, in each case excluding the AstraZeneca corporate name and related logos.
Product Trademarks means any trademarks and trade names, whether or not registered, and any trademark applications, renewals, extensions or modifications thereto in the Territory together with all goodwill associated therewith, trade dress and packaging which are applied to or used with Products, and any promotional materials relating thereto.
Product Trademarks means any trademarks, service marks, trade dress, or logos used specifically for, or for which registration is applied for or issued specifically with respect to, any Licensed Products at any time in connection with the use, development, promotion, marketing, distribution, offer for sale, or sale of such Licensed Products, including but not limited to any and all rights to the foregoing existing solely under common law, statute, or similar bases not requiring explicit government notice or registration.
Product Trademarks means the trademarks developed for the Collaboration Products by the Steering Committee, all packaging designs and other trade dress used in connection with the Collaboration Products and such other Trademarks relating thereto and any registrations thereof or any pending applications relating thereto.
