Product Trademark definition

Product Trademark means (a) any trademark or trade name, whether or not registered, or any trademark application, renewal, extension or modification thereto, in the Territory, or any trade dress and packaging, that is applied to or used with Products by Xxxxxx and (b) all goodwill associated therewith, and any promotional materials relating thereto.
Product Trademark has the meaning set forth in Section ‎9.6(a).
Product Trademark has the meaning provided in Article 1.

  • Celgene shall assume full responsibility, at its sole cost and expense, for any infringement of a Product Trademark for a Licensed Product by a Third Party (and shall retain in full any recoveries for such infringement) and shall defend and indemnify Acceleron for and against any claims of infringement of the rights of a Third Party by Acceleron’s use of a Product Trademark in connection with a Licensed Product in accordance with the terms of this Agreement.

  • If PPD has registered any Product Trademarks for any Licensed Product(s) related solely to such Licensed Product(s), upon written request from Xxxxxxx, PPD will cooperate with and execute any reasonable, necessary assignment and transfer documents prepared by Xxxxxxx to effectuate an assignment of the Product Trademark to Xxxxxxx, at Xxxxxxx’x cost for the assignment and transfer documents and any governmental fees for effecting such assignment.

  • If Xxxxxxx has registered any Product Trademarks for the Licensed Product related solely to such Licensed Product, upon written request from PPD, Xxxxxxx will cooperate with and execute any reasonable and necessary assignment and transfer documents prepared by PPD to effectuate an assignment of the Product Trademark to PPD, at PPD’s cost for the assignment and transfer documents and any governmental fees for effecting such assignment.

  • Quoin shall maintain the Product Trademark registration in the Territory throughout the Term.

  • Licensee agrees that in using the Product Trademark in its activities under this Agreement, it will not represent in any way that it has any right or title to the ownership of the Product Trademark or the registration therefor.


More Definitions of Product Trademark

Product Trademark has the meaning set forth in Section 6.3(a) (Product Trademark; Licensee Trademark).
Product Trademark means such trademark(s) as may be approved by the Steering Committee for use in connection with the distribution, marketing, promotion and sale of the Product in the Territory and/or accompanying logos, trade dress and/or indicia of origin.

"Product Trademark" shall not include the marks AMGEN or VIACELL.
Product Trademark means, with respect to each Licensed Product in the Field in the Territory, the trademark(s) selected by the JCC and approved by the JSC for use on such Licensed Product throughout the Territory and/or accompanying logos, slogans, trade names, trade dress and/or other indicia of origin, in each case as selected by the JCC and approved by the JSC.
Product Trademark means the main (global) trademark for the Product(s) in the Territory.
