Covered Nitric Acid Plants definition

Covered Nitric Acid Plants means the nine Nitric Acid Plants that are subject to this Consent Decree: two at the Port Neal Facility (“Port Neal #1 and #2”); two at the Verdigris Facility (“Verdigris #1 and #2”); one at the Woodward Facility (“Woodward #1”); and four at the Yazoo City Facility (“Yazoo #6, #8, #9 and #10”).
Covered Nitric Acid Plants means all ten of Settling Defendants’ owned and/or operated Nitric Acid Plants in the United States that are subject to this Consent Decree: two at the Cherokee Facility (Cherokee #1 and #2); one at the Baytown Facility (Baytown); four at the El Dorado Facility (El Dorado East, El Dorado West, El Dorado DMW, and El Dorado DSN); and three at the Pryor Facility (Pryor #1, #3, and #4);
Covered Nitric Acid Plants means all ten of LSB’s Nitric Acid Plants at the Pryor Facility (Pryor #1, and #4);

  • This provision does not apply to the transfer of the Covered Nitric Acid Plant(s) after Partial Termination of this Consent Decree, pursuant to Paragraph 107, as to the relevant Facility where such Covered Nitric Acid Plant(s) are located.

  • The United States and the State Parties further reserve all legal and equitable remedies to address any imminent and substantial endangerment to the public health or welfare or the environment arising at, or posed by, the Covered Nitric Acid Plants, whether related to the violations addressed in this Consent Decree or otherwise.

  • Terra shall obtain all required federal, state, and local permits necessary for performing any compliance obligation under this Consent Decree, including but not limited to, permits for construction of pollution control technology and the installation of equipment at the Covered Nitric Acid Plants.

  • No transfer of ownership or operation of any of the Covered Nitric Acid Plants, whether in compliance with the procedures of this Paragraph or otherwise, shall relieve Terra of its respective obligations to ensure that the terms of this Consent Decree are implemented.

  • COVID-19 symptoms means fever of 100.4 degrees Fahrenheit or higher, chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, or diarrhea, unless a licensed health care professional determines the person’s symptoms were caused by a known condition other than COVID-19.

  • Low terrain means any area other than high terrain.

  • COVID-19 Measures means any quarantine, “shelter in place,” “stay at home,” workforce reduction, social distancing, shut down, closure, sequester or any other Law, directive, guidelines or recommendations by any Governmental Authority (including the Centers for Disease Control and the World Health Organization) in each case in connection with, related to or in response to COVID-19, including the Coronavirus Aid, Relief, and Economic Security Act (CARES) or any changes thereto.

  • High global warming potential hydrofluorocarbons means any hydrofluorocarbons in a particular end use for which EPA’s Significant New Alternatives Policy (SNAP) program has identified other acceptable alternatives that have lower global warming potential. The SNAP list of alternatives is found at 40 CFR part 82, subpart G, with supplemental tables of alternatives available at (http://www.epa.gov/snap/ ).

  • Short-term acute care facility means a facility or Hospital that provides care to people with medical needs requiring short-term Hospital stay in an acute or critical setting such as for recovery following a surgery, care following sudden Sickness, Injury, or flare-up of a chronic Sickness.

  • Processing Plant means plant systems, located on or off the Leased Premises, that include a gas processing plant, natural gasoline plant, gasoline plant, or other plant where raw unprocessed natural gas is processed to remove or extract Raw Mix from the natural gas stream to produce a Pipeline- Quality Natural Gas or Residue Gas and other products, and the Raw Mix is then either (i) separated by fractionation down to its base components prior to storage and/or transport that meets or conforms to all applicable Gas Processors Association (GPA) Standards and/or Specifications for the commercial sale of each liquefiable hydrocarbon product, or (ii) transported to another plant for separation down to its base components by fractionation prior to storage and/or transport for the commercial sale of each liquefiable hydrocarbon product. Any deductions, costs, or processing fees associated with the removal or recovery of Natural Gas Liquids is strictly limited to only that part of any Processing Plant or facility where Raw Mix is recovered, and if applicable at that plant, also fractionated to their component parts.

  • Pump spray means a packaging system in which the product ingredients within the container are not under pressure and in which the product is expelled only while a pumping action is applied to a button, trigger or other actuator.
