All references in this Agreement to Holders of beneficial interests in the Liquidating Trust shall be read to mean Holders of record as set forth in the Claims Register, as maintained by the Liquidating Trustee.
All notices to be given to Beneficiaries may be given by ordinary mail or may be delivered personally to the Holders at the addresses appearing on the books or the Claims Register kept by the Liquidating Trust.
The initial Claims Register shall be delivered to the Liquidating Trustee by the Debtors and shall be based on the list of Holders of unpaid Claims maintained by the Claims Agent as of the Effective Date.
The Liquidating Trustee may deem and treat any Beneficiary reflected as the owner of a beneficial interest on the Claims Register as the absolute owner thereof for the purposes of receiving Distributions and payments on account thereof, for federal and state income tax purposes, and for all other purposes whatsoever.
The Liquidating Trustee shall maintain at all times a register of the names, distribution addresses, amounts of asserted and Allowed Claims, and the ratable interests in the Liquidating Trust of the Beneficiaries, with such register permitted to be the Claims Register, as the same may be updated from time to time at the direction of the Liquidating Trustee in the ordinary course of administering the Liquidating Trust.
