Applicable Traffic definition

Applicable Traffic consists of Reciprocal Compensation Traffic (including, without limitation, for purposes of this Amendment and no other purpose, Reciprocal Compensation Traffic originated by MCI UNE-P Customers and terminated to Verizon Customers, ISP-Bound Traffic (including, for purposes of this Amendment and for no other purpose, V/FX Traffic that is ISP-Bound Traffic), and Type 1 VOIP Traffic. Applicable Traffic does not include Reciprocal Compensation Traffic originated by Verizon Customers and terminated to MCI UNE-P Customers. Applicable Traffic also does not include Type 2 VOIP Traffic or V/FX Traffic that is not ISP-bound Traffic, each of which types of traffic is subject to applicable switched exchange access tariff charges; the Parties hereby agree that, as of the Effective Date, they are exchanging only a de minimis amount of V/FX Traffic that is not ISP-bound Traffic; the Parties further agree that, from time to time, upon written request from either Party, the Parties will review whether the amount of such V/FX Traffic that is not ISP-bound Traffic exchanged between them remains de minimis. For the purpose of calculating traffic ratios only, and not for the purpose of calculating intercarrier compensation, “Applicable Traffic” also includes Reciprocal Compensation Traffic originated by Verizon Customers and terminated to MCI UNE-P Customers.

Examples of Applicable Traffic in a sentence

  • Each pre-application must include an original of the following: Certified Engineer's Cost Estimate Certified Engineer's Statement of Impact - Problem Solution (If Applicable) Traffic Studies - Engineering Reports (If Applicable) Certified Engineer's Useful Life Estimate Location Map – 8.5” x 11” maps are preferable.

  • Applicable Traffic Category derived from Design Traffic, as shown in Table 3051/A.N1 below.

  • Applicable Traffic does not include Reciprocal Compensation Traffic originated by Verizon Customers and terminated to MCI UNE-P Customers.

  • The Parties anticipate that the terms set forth in this Amendment will greatly reduce (if not eliminate) the incidence of billing disputes between them with respect to Applicable Traffic and other traffic addressed in this Amendment (e.g., Type 2 VOIP Traffic).

  • Traffic Control and Public Safety (as Applicable) Traffic Control: The Contractor will provide and maintain barricades, lights and other means as may be necessary to prevent accidents to the public, to direct traffic, protect workers and public from injury or damage due to any cause.

  • If the Applicable Traffic destined for an End Office exceeds the CCS busy hour equivalent of two (2) DS1s, Verizon may request, and MCI shall order, Direct End Office Trunks (“DEOTs”) to that End Office.

  • In any Verizon Tandem serving area in which MCI does not assign its own or ported telephone numbers, MCI shall deliver Applicable Traffic for termination to Verizon at a technically feasible POI at the terminating Verizon Tandem or End Office Wire Center.

  • If the Receiving Party lacks the ability to use CPN information to classify on an automated basis traffic delivered by the other Party as either Applicable Traffic or toll traffic, the Originating Party will supply an auditable Percent Local Usage (PLU) report quarterly, based on the previous three (3) months’ traffic, and applicable to the following three (3) months’ traffic.

  • Subject to subsections (e) and (f) directly below, neither Party may charge (and neither Party shall have an obligation to pay) any fees, charges or the like (including, without limitation, any transport charges), with respect to Applicable Traffic that either Party delivers at a mutual POI, other than the Unitary Rates for Applicable Traffic.

  • For the purpose of calculating the Aggregated Traffic Ratio, MOUs of Applicable Traffic exchanged between Verizon and MCI over UNE-P lines provided to MCI by Verizon shall be included in such calculation.

Related to Applicable Traffic

  • Applicable codes means uniform building, fire, electrical,

  • Available Transfer Capability or “ATC” shall mean a measure of the transfer capability remaining in the physical transmission network for further commercial activity over and above already committed uses.

  • Transit Traffic means traffic originating on CLEC’s network that is switched and transported by AT&T-TSP and delivered to a Third Party Terminating Carrier’s network or traffic from a Third Party Originating Carrier’s network. A call that is originated or terminated by a CLEC purchasing local switching pursuant to a commercial agreement with AT&T-TSP is not considered Transit Traffic for the purposes of this Attachment. Additionally Transit Traffic does not include traffic to/from IXCs.

  • Incremental Available Transfer Capability Revenue Rights means the rights to revenues that are derived from incremental Available Transfer Capability created by the addition of Merchant Transmission Facilities or of one of more Customer-Funded Upgrades.

  • Applicable ABR Margin means, at any date:

  • VNXX Traffic is all traffic originated by a Party’s End User Customer and dialed with a local dialing pattern that is not terminated to the other Party’s End User Customer physically located within the same CenturyLink Local Calling Area (as approved by the state Commission) as the originating caller, regardless of the NPA-NXX dialed. VNXX does not include originating 8XX traffic.

  • Applicable Wages means the basic straight time wages for all hours worked, including:

  • Transit Traffic MOUs means all Transit Traffic minutes of use to be billed at the Transit Traffic rate by AT&T-TSP.

  • InterMTA Traffic is: (a) traffic originated by a CMRS end user of ALLTEL in an MTA and terminated to an end user of MATC in another MTA; and (b) traffic originated by an end user of MATC in one MTA and terminated to an end user of ALLTEL in another MTA.

  • Applicable Regulations As to any Mortgage Loan, all federal, state and local laws, statutes, rules and regulations applicable thereto.

  • Local Traffic means traffic (excluding Commercial Mobile Radio Service “CMRS” traffic) that is originated and terminated within Embarq’s local calling area, or mandatory extended area service (EAS) area, as defined by the Commission or, if not defined by the Commission, then as defined in existing Embarq Tariffs. For this purpose, Local Traffic does not include any ISP-Bound Traffic.

  • Applicable Unused Line Fee Margin means the per annum fee, from time to time in effect, payable in respect of Borrowers’ non-use of committed funds pursuant to Section 1.9(b), which fee is determined by reference to Section 1.5(a).

  • Permitted Amount means, on any date, an amount equal to 3.5 times Adjusted EBITDA as of the most recent fiscal quarter for which financial statements of the Company are internally available immediately preceding such date.

  • Applicable L/C Margin means the per annum fee, from time to time in effect, payable with respect to outstanding Letter of Credit Obligations as determined by reference to Section 1.5(a).

  • Serious traffic violation means a conviction when operating a commercial motor vehicle of:

  • Applicable Commitment Fee Margin means, for each Pricing Period, the margin set forth below (expressed in basis points per annum) opposite the Applicable Pricing Level for that Pricing Period: Applicable Pricing Level Margin II 10.0 V 17.5

  • Applicable requirement means all of the following as they apply to emission units in a source requiring an air quality operating permit (including requirements that have been promulgated or approved by the Department or the administrator through rule making at the time of issuance of the air quality operating permit, but have future-effective compliance dates, provided that such requirements apply to sources covered under the operating permit):

  • InterLATA Traffic describes Telecommunications between a point located in a Local Access and Transport Area ("LATA") and a point located outside such area.

  • Local Access Transport Area or "LATA" is as defined in the Act.

  • Applicable Utilization Fee Rate means, as of any date, the percentage rate per annum at which Utilization Fees accrue on all Revolving Credit Advances at such time as set forth in the Pricing Schedule.

  • Applicable ECF Percentage means, for any fiscal year, (a) 50% if the Total Leverage Ratio as of the last day of such fiscal year is greater than or equal to 6.00 to 1.00, (b) 25% if the Total Leverage Ratio as of the last day of such fiscal year is less than 6.00 to 1.00 but greater than or equal to 5.00 to 1.00 and (c) 0% if the Total Leverage Ratio as of the last day of such fiscal year is less than 5.00 to 1.00.

  • Sex trafficking means the recruitment, harboring, transportation, provision, or obtaining of a person for the purpose of a commercial sex act.

  • Applicable Revolver LIBOR Margin means the per annum interest rate from time to time in effect and payable in addition to the LIBOR Rate applicable to the Revolving Loan, as determined by reference to Section 1.5(a).

  • Applicable Unused Line Fee Percentage means, as of any date of determination, the applicable percentage set forth in the following table that corresponds to the Average Revolver Usage of Borrowers for the most recently completed month as determined by Agent in its Permitted Discretion; provided, that for the period from the Closing Date through and including February 28, 2015, the Applicable Unused Line Fee Percentage shall be set at the rate in the row styled "Level II"; provided further, that any time an Event of Default has occurred and is continuing, the Applicable Unused Line Fee Percentage shall be set at the margin in the row styled "Level II": Level Average Revolver Usage Applicable Unused Line Fee Percentage I > 50% of the Maximum Revolver Amount 0.25 percentage points II < 50% of the Maximum Revolver Amount 0.375 percentage points The Applicable Unused Line Fee Percentage shall be re-determined on the first date of each fiscal month of Borrowers by Agent.

  • Applicable LIBOR Margin means a per annum rate of interest payable in addition to the LIBOR Rate on LIBOR Rate Loans, determined by reference to Section 1.6.
