Xxxxx Xxxxx Xxxxxiciaries. (x) Xxx xxpresentations, warranties and agreements made by the Mortgage Loan Seller in this Agreement are made for the benefit of, and, to the extent they are assigned by the Company to the Trustee under the Pooling and Servicing Agreement, may be enforced by or on behalf of, the Trustee, each Servicer (as to the Mortgage Loans serviced by such Servicer) or each Special Servicer (as to the Mortgage Loans serviced by such Special Servicer), as provided in the Pooling and Servicing Agreement, to the same extent that the Company has rights against the Mortgage Loan Seller under this Agreement in respect of representations, warranties and agreements made by the Mortgage Loan Seller herein.

In the event that any of said third party beneficiaries become an assignee or successor to Lender and, as such assignee or successor of Lender, enforce this Agreement, as it may be amended, against Great Lakes, then said third party beneficiary shall succeed to the duties and obligations of the Lender under this Agreement, as it may be amended.
