Waiver of recourse. 10.4.1 Concerning death and/or personal injury or illness of a member of personnel of one of the Parties and except for gross negligence or wilful misconduct, the Parties mutually waive all claims they may have against each other for such damages caused to their member of personnel or proxy holder.
Waiver of recourse. The Contractor shall, to the extent that any of its property is required under this Agreement to be insured against, waive any right of recourse against the Province in regard to any loss or damage to such property, and shall make its insurer(s) aware of such waiver.
Waiver of recourse. The Lessee, as well as its insurers, waive any recourse against the Lessor to obtain compensation for the financial consequences of any indirect and/or immaterial damage claim by the Lessee, the Lessee's personnel or third parties and indemnify the Lessor and its insurers against any claim made by third parties concerning the aforementioned damage.
Waiver of recourse. If one of the parties to this Agreement fails to exercise a right resulting under this Agreement or any Contractual Document or exercises the said right late, this will not constitute a waiver of the exercise of this right and will not prevent the party concerned from exercising this right in the future.
Waiver of recourse. ABSENCE OF JOINT AND SEVERAL LIABILITY The Shipper waives the right to recourse against the other Shippers in respect of the damages that it may suffer in the situations referred to in paragraphs 3 and 4 above in excess of the amounts stipulated in Articles 3.3 and 4.2 of this Appendix. There is no joint and several liability between Shippers under this Contract.
Waiver of recourse. The policies taken out by the Lessee contain a waiver of recourse clause with regard to the Lessor and the companies affiliated to the Lessor as stipulated in article 1:20 of the Companies and Associations Code, as well as their respective directors, their representatives, appointees or executive agents and subcontractors. The exemption and the non-covered risks are at the expense of the Lessee.
Waiver of recourse. The Principal, as well as its insurers, waive any recourse against the Service Provider to obtain compensation for the financial consequences of any indirect and/or immaterial damage claim by the Principal the Principal's personnel or third parties and indemnify the Service Provider and its insurers against any claim made by third parties concerning the aforementioned damage.
Waiver of recourse. The Indemnifier hereby expressly waives any right to require the Landlord to proceed against the Tenant or to proceed against or to exhaust any security held or acquired by the Landlord from the Tenant to pursue any other remedy whatsoever which may be available to the Landlord; before proceeding against the Indemnifier.
Waiver of recourse. The Insurer shall have no right of recourse against any Insureds for any payment of Loss made by the Insurer under this Liability Coverage Part because of a Wrongful Act by such Insureds if the premium for this Policy was paid for by other than an Insured Plan.
