Common use of VOLUNTARILY BY EMPLOYEE Clause in Contracts

VOLUNTARILY BY EMPLOYEE. Employee may, at his option, terminate his employment under this Agreement at any time upon ninety (90) days prior written notice to Employer. If Employee voluntarily terminates employment with Employer, then Employee shall receive only (i) his Base Salary and benefits earned but unpaid up to the date of termination of employment, (ii) two weeks salary, calculated based on Employee's salary then in effect at the time of termination of employment, (iii) the prorated portion of any bonuses earned but unpaid at the time of termination of employment, calculated in accordance with subsection (a)(ii) above; and, if Employee voluntarily terminates his employment pursuant to Section 20, Employee shall also be entitled to retain any exercisable stock options.

VOLUNTARILY BY EMPLOYEE. Employee may, at his option, terminate his employment under this Agreement at any time anytime after the second anniversary of the effective date herein upon ninety (90) days prior written notice to Employer. If Employee voluntarily terminates employment with Employer, then Employee shall receive only (i) his Base Salary and benefits earned but unpaid up to the date of termination of employment, (ii) two weeks salary, calculated based on Employee's salary then in effect at the time of termination of employment, (iii) the prorated portion of any bonuses earned but unpaid at the time of termination of employment, calculated in accordance with subsection (a)(ii) above; and, if Employee voluntarily terminates his employment pursuant to Section 20, Employee shall also be entitled to retain any exercisable stock options.
