Use of the Card. You may use the Card to obtain legal goods and services from any person or establishment accepting the Card (“Purchase(s)”), and obtain loans (“Cash Advance(s)”) from us up to the applicable limits on your Account and to take advantage of other features of the Card. As used in this Agreement, the term “Purchases” will include Purchases, and the term “Cash Advances” will include; a) Cash Advances, b) Convenience Checks, c) obtaining funds through an automated teller machine (ATM) or a financial institution, d) purchasing a wire transfer, money order, foreign currency, travelers cheques, or stored value load, e) engaging in another similar transaction, or f) Balance Transfers. As used in this Agreement, all amounts charged to an Account, which include Purchases, Cash Advances, the Annual Card fee, if any, or other fees, and any Interest Charges imposed under Agreement, will be called “Charges”. Charges included (but not limited to) any Purchase, Balance Transfer, Cash Advance or Convenience Check in which you have evidenced intent to incur a Charge, regardless of whether you have signed a charge form. You are responsible for paying all amounts charged to the Account by either you or any Additional Cardholders. You agree to notify us at once if the Card or any Convenience Checks we may issue on your Account are lost or stolen, or if you suspect they are being used without your permission. You agree to use the Account only for legal purchases of goods and services. Cards may not be used for gambling purposes, whether on the internet or otherwise. If you do use your Card for illegal purposes or gambling, you will be in default under this Agreement and we may terminate your Account, but you still will be liable to us for all Charges relating to such transactions and all other transactions on your Account. You should not use the Card after the expiration date. If you want to cancel your Account or any Additional Cards, you must contact us and destroy the Card or any Additional Cards. We reserve the right to deny authorization for any requested Charge. All Purchases are affected at the option of the Seller and Cash Advancing Financial Institution and Solvay Bank shall not be responsible for refusal by any Seller or Cash Advancing Financial Institution to honor the Cards or any Related Card. Any refund, adjustment or credit allowed by Seller shall not be by cash but rather by a credit advice to Solvay Bank which shall be shown as a credit on Cardholders account statement with Solvay Bank. ADDITIONAL CARDS: You, as the Primary Cardholder, are responsible for all Charges on your Account. Any Additional Card may be canceled by you or by us. You agree to make sure that any Additional Cards issued on your Account are used in a manner consistent with this Agreement. You also authorize us to discuss your Account with Additional Cardholders in the course of maintaining your Account. We may, in our sole discretion, pursue Additional Cardholders for payment of their own charges if you fail to pay those charges.

You agree to take reasonable steps to prevent the unauthorized use of any Card, Convenience Checks and your Account. You agree to sign the Card immediately when you receive it. You agree to use the Account (including any Card and Convenience Checks) only for legal purchases of goods and servicesservices and not to use the Account, Cards and/or Convenience Checks for any unlawful purposes, including the purchase of goods or services prohibited by applicable laws or regulations. You expressly agree that Cards may not be used for gambling or wagering purposes, whether on the internet online or otherwise, even if it otherwise permitted by applicable law. If you or any Authorized Users do use your Card Cards for unlawful purposes, including, without limitation, illegal internet gambling, and /or for any purposes or gamblingwhich we do not permit, you will be in default under this Agreement and we may terminate your Account, but you still will be liable to us for all Charges relating to such transactions and all other transactions on your Account. You should not use the Card after the expiration date. You must immediately return the Card to us or destroy it if we ask you to. If you want to cancel your Account or any Additional Cards, you must contact us and destroy the Card or any Additional Cardsapplicable Card. We reserve the right to deny authorization for any requested ChargeCharge even if the transaction would not cause you to exceed your credit limit or your Account is not in default. All Purchases You agree to use your Account for personal, family or household purposes and not to use your Account for business or commercial purposes. We are affected at the option of the Seller and Cash Advancing Financial Institution and Solvay Bank shall not be responsible for refusal by any Seller losses you may incur if we do not authorize a requested Charge or Cash Advancing Financial Institution if anyone refuses to honor the Cards accept your Card or any Related CardConvenience Check for any reason. You may obtain Cash Advances and Balance Transfers as permitted for your Account as described in this Agreement, but you may not use these to pay any amount you owe us or any of our affiliates or agents. We are not liable for any losses that may result when our services are unavailable due to reasons beyond our control. Credit Line Maintenance: You agree to provide financial statements on the Cardholder as requested by us. Failure to do so may result in the suspension of charging privileges on your Account. You also agree to provide us with any information required by law or regulation, including information that may be required under the USA Patriot Act. Transfers: You may not transfer your Account or any of your rights and obligations under this Agreement. Any refund, adjustment or credit allowed by Seller shall not such transfer will be by cash but rather by a credit advice to Solvay Bank which shall be shown as a credit on Cardholders account statement with Solvay Bankvoid. ADDITIONAL CARDSAdditional Cards: You, as the Primary Cardholder, are responsible for all Charges on your Account. Any Additional Card Cards may be canceled by you or by us. You agree to make sure that any Additional Cards issued on your Account are used in a manner consistent with this Agreement. You also authorize us to discuss your Account with Additional Cardholders Authorized Users in the course of maintaining your Account. We may, in our sole discretion, pursue Additional Cardholders Authorized Users for payment of their own charges Charges if you fail to pay those chargesCharges. If you want to end an Authorized User’s privilege to use your Account, you must recover and destroy that person’s Card. If you do not, you will continue to be liable for any charges made, even if you have advised us of your wish to cancel that person’s Card privileges, unless you tell us to cancel all Cards and establish a new Account for you or you report the Card as lost or stolen. You agree to notify each Authorized User that they are subject to all applicable sections of this Agreement. Credit Limit: The Credit Limit is the maximum amount of credit available on your Account. We have provided you a separate written notice stating the applicable credit limit(s) on your Account. In addition, your monthly statements will show the amount of credit available to you for Purchases, Balance Transfers and Cash Advances and the ANNUAL PERCENTAGE RATES (APRs) for Purchases, Balance Transfers and Cash Advances, as of the monthly statement date. You agree not to use the Account in any way that would make the unpaid balance of your Account exceed the applicable credit limit. We are not obligated to honor any Card transaction that would cause the unpaid balance of your Account to exceed applicable credit limits (“Over Limit Transactions”). However, if we, in our discretion, honor any Over Limit Transaction, you agree to promptly pay the amount more than the applicable credit limit. At our discretion, and subject to applicable law, we may increase, reduce your Credit Limit or the Balance Transfer or Cash Advance portions of your Credit Limit or cancel your Credit Limit, at any time. A change to your Credit Limit or any portion thereof does not affect your obligation to pay us. Promotional Offers: At our discretion, we may offer you a promotional ANNUAL PERCENTAGE RATE for all or a part of any balances or for certain types of transactions. The period of time for which the promotional rate applies may be limited. Any applicable promotional rate, the corresponding periodic rates, and the period of time during which it will be in effect will appear on the Account Opening Disclosure or be included on a promotional letter. Any promotional rate offer will be subject to the terms of the offer and this Agreement.

Use of the Card. You may Purchasing and cash advance privileges (if allowed) on the Card and Account are provided by the Bank pursuant to the GSA Contract and one or more task orders between the Bank and my Agency/Organization, and are subject to this Agreement. Use of the Card. You All Boost Beyond Cards are issued with contactless functionality and are MasterCard PayPass enabled. Once the Boost Beyond Card is activated and you have topped-up the Card with sufficient funds, you may start to use the Boost Beyond Card to purchase goods and services worldwide anywhere a MasterCard card is accepted and also to access cash at ATMs or financial institutions displaying the MasterCard name and/or logo, whereupon for ATM functionality, Boost shall duly inform the Cardholder within the App of its availability. Each time you use the Card to obtain legal purchase goods or services, you authorize us to deduct your funds from your Card Account. The Card is non-transferable and services from shall only be used exclusively by you as the Cardholder. Your Card shall not be pledged by you as security for any person or establishment accepting the Card (“Purchase(s)”), and obtain loans (“Cash Advance(s)”) from us up to the applicable limits on your Account and to take advantage of other features of the Card. If you opt for any optional services provided by us (if applicable), then you may terminate your Accounthave to maintain a minimum amount as specified in connection with the use of those services. We may further set certain limits and thresholds for specific use categories (within the Card Limit) which you cannot exceed whether daily, but you still will monthly or so on. We may further refuse any Transaction or limit the amount to be liable to us transacted either on a per transaction or aggregated basis at any time and for all Charges relating to such transactions and all other transactions on your Accountany reason. You should frequently review your Card Account to check and verify your Available Balance before using your Card. You must always ensure that there are sufficient funds in your Card Account to pay for each transaction and to cover the total amount transacted on your Card Account, including purchases, recurring transactions, fees and other charges. If the total amount in your Card account is insufficient, your transaction will be declined and in the case of recurring declined transactions, you would have to make your own arrangements for payment with the recurring merchant, and we shall not use the Card after the expiration datebe liable for any penalty or late payment interest charged by such merchant on you. If you want have not paid any of the fees (as may be applicable), your Card cannot be used and we will be entitled to cancel block, suspend and/or to terminate your Card account. Without prejudice to the above, we shall not be responsible for the refusal of any Merchant or member institution of Mastercard to honour or accept your Card. All transactions conducted with your Card will only be reflected and posted to your Card Account after they have been submitted by the respective Merchant or acquiring bank and processed by the Mastercard payment network and authorised ONLY by Xxxxx. Take note, as part of our CDD requirements and security monitoring process, Boost reserves the right to review your Card Account activities and any Additional CardsTransaction at any point in time in order to protect you and your funds and to ensure the validity, safety and security of your Card Account against money laundering, terrorism financing, fraudulent or illegal activities. As a provider of financial services, Xxxxx also plays an important role in the fight against financial crime, money laundering and terrorist financing activities and as a result, the Applicable Laws require us to obtain, verify and record personal and private information about our customers and to conduct periodic account reviews. These processes often include steps that involve additional verification and validation of identity, payment or funding sources and instructions, and of other Transaction information which may require us to contact you must contact us further for the relevant information, which may result in delay in the processing of a Transaction until such verification and destroy validation is satisfactorily completed. In the Card or event that your Transaction is subject to any Additional Cardsprocess for additional verification and/or validation (including AML compliance checks), your Transaction may be put on hold while we collect and confirm the source of the funds and complete the verification and validation process. We reserve the right to deny authorization refuse to process Transactions for any requested Charge. Use of the Card. To activate the Card you will need to log onto the Card Partner App or Card Partner’s Website and use the activate card function. We will be entitled to assume that a Transaction has been Authorised by You may where (i) the magnetic strip on the Card was swiped by the Merchant; (ii) the Card was inserted into a chip & PIN device and the PIN was entered; (iii) relevant information was supplied to the Merchant that allows them to process the Transaction, for example, providing the Merchant with the 3-digit security code on the back of the Card in the case of an internet or other non-face-to-face Transaction; or (iv) the Card is tapped against a contactless-enabled reader and accepted by such reader. The Cardholder should only use the Card as permitted by the Business. If the Cardholder uses the Card, we are entitled to obtain legal goods and services from any person or establishment accepting presume that the Cardholder has the Business’ permission to spend the Available Balance until notified to the contrary by the Business. The Cardholder can use the Card up to the amount of the Available Balance for Transactions (“Purchase(s)”)i) via the Internet, (ii) at Merchants and obtain loans (“Cash Advance(s)”iii) to make cash withdrawals from ATMs, provided that such application is included in the card program. We will deduct the value of the Transactions from the Available Balance in the Account. We will also deduct any applicable Fees as soon as they become payable by the Business based upon the Fees Schedule. ATM withdrawals may also be subject to fees, foreign exchange rates, maximum withdrawal limits, rules and regulations of the relevant ATM operator or bank. It is your responsibility to check whether any such additional fees apply, as they cannot be refunded once the cash has been withdrawn. Like other card issuers, we cannot guarantee a Merchant, an ATM operator or a bank will accept the Card. We may at any time suspend, restrict or terminate the Card and/or the Account, refuse to issue or replace a Card or refuse to authorise a Transaction for reasons relating to the following: ● if we have reasonable grounds to believe that the Card is being in a way which is not approved by the Business; ● if we have reasonable grounds to believe that the security of the Card has been compromised or suspect that the Card is being used in an unauthorised or fraudulent manner; ● if there is insufficient Available Balance in the Account at the time of a Transaction to cover the amount of the Transaction and any applicable Fees; ● if there is an outstanding Shortfall in the Account; ● if we have reasonable grounds to believe that you are acting in breach of this Agreement; ● if we have reasonable grounds to believe that a Transaction is potentially suspicious or illegal (for example, if we believe that a Transaction is being made fraudulently) or because of errors, failures (whether mechanical or otherwise) or refusals by Merchants, payment processors or payment schemes processing Transactions, or ● if we need to do so in order to comply with the law. If we do this, we will inform you of the action taken and its reasons in advance or, if that is not possible, immediately after, unless to do so would compromise reasonable security measures or be otherwise unlawful. We will reactivate the Account and where appropriate issue you with a replacement Card if after further investigations we reasonably believe that the reasons for the action no longer apply. The Business will remain responsible to the Issuer for the use of the Card. Your ability to use or access the Card may occasionally be interrupted, for example, if we need to carry out maintenance on our systems. Please contact us using the contact details set out in clause 2 to notify us of any problems you are experiencing using the Card or Account and we will endeavour to resolve any problem. You can manage the Card and view your e-statements by accessing the Account online via the Card Partner's Website or Card Partner App. You may at any time view the details of the Transactions in the Account using the relevant credentials. You must keep your credentials safe and not disclose them to anyone. As used in this Agreement, all amounts charged to an Account, which include Purchases, Cash Advances, the Annual Card fee, if any, or other fees, and any Interest Charges imposed under Agreement, will be called “Charges”. Charges included (but not limited to) any Purchase, Balance Transfer, Cash Advance or Convenience Check in which you have evidenced intent to incur a Charge, regardless of whether you have signed a charge form. You are responsible for paying all amounts charged to the Account by either you or any Additional Cardholders. You provide your consent for us to communicate (by telephone, mail, email, SMS text message or any other electronic communication method) with any Authorized User regarding all Charges on details and matters related to your Account. Any Additional Card may be canceled by you or by us. You agree For greater certainty, this also means that we are permitted, but not obligated, to make sure that provide any Additional Cards issued on your Account are used in a manner consistent with this Agreement. You also authorize us Authorized User online access to discuss your Account with Additional Cardholders in the course of maintaining your Account. We maymay decline an authorization request for any Transaction at any time for any reason. We may also request additional information at any time to evaluate a Transaction request or to evaluate and adjust the rates of interest, in our sole discretioncredit limit or other features of your Account. When any Cardholder on the Account pays for goods or services with the Account number without presenting his or her Card (such as for Purchases by telephone, pursue Additional Cardholders for payment of their own charges mail, Internet, mobile or any other electronic method) or where a signature, PIN or password is not required, the legal effect is the same as if the Card had been presented and the sales slip was signed or a PIN or password entered. You must sign any Card that has a signature panel as soon as you fail receive it and ensure that the Authorized Users on the Account sign any Cards that include a signature panel as soon as they receive them. However, the Primary Cardholder agrees to pay those chargesall debts incurred on the Account, even if these debts are incurred prior to activation of the Account or after the expiry of any Card or after the closure or suspension of the Account. Your Card or Account number must not be used for any illegal or unlawful purpose, including the purchase of goods or services prohibited by the laws of Canada or any other country where the Card is used or where the goods or services are provided. We have the right to prevent your Card or your Account from being used for certain types of transactions as determined by us without advance notice to you. All Cards are the property of Xxxxxx Bank and must be returned to us on our request.

However, if we, in our discretion, honor any Over Limit Transaction, you agree to promptly pay the amount more than the applicable credit limit. Use of the Card. You may use your Card in accordance with the terms of this Agreement for those purposes that we agree to, including:  to pay for Purchases; and  to obtain Cash Advances. When any Cardholder makes a Transaction using the Account, we lend the Primary Cardholder the amount required for the Transaction, and the Primary Cardholder authorizes us to charge the Account and promises to pay Xxxxxx Bank for all Transactions made with the Account, whether or not transaction alerts have been provided to a Cardholder with respect to the Transactions (when this service is available), whether they were made by the Primary Cardholder, an Authorized User, or someone else that a Cardholder permitted to use your Account, and for any applicable Fees, premiums or interest. If you have a physical Card, enter your PIN (or sign the receipt with the same signature you used when you signed the Card). You may should retain the receipt as a record of the transaction. If you use your Card for card-not-present transactions (such as online, mail or telephone purchases), the legal effect is the same as if you used the Card at retail where you are asked to present your Card. Some merchants (including, but not limited to, fuel stations, restaurants, hotels, cruise lines, or car rental companies) may pre-authorize the transaction amount for the purchase amount plus up to 20% (or more) above the purchase amount to ensure that there are sufficient funds available on the Card to cover any tips or incidental expenses. In such cases, your transaction will be declined if the Card Balance will not cover the transaction amount plus the additional amount. A pre-authorization will place a ‘hold’ on an amount of your available Card funds until the merchant sends us the final payment amount of their own charges if your purchase. Once the final payment amount is received, the pre- authorization amount on hold in excess of that final payment amount will be released. The time it takes for a pre-authorization hold to be removed may vary depending on the type of merchant. A hold is typically removed within eight (8) days for most standard merchants, and within thirty (30) days for hotels, cruise lines and car rental agencies. During the hold period, you fail will not have access to pay those chargesthe pre-authorized amount. Loading Funds: The Card is reloadable and the methods available for adding or transferring funds to the Card are available on the Website. The load methods may change from time to time. Some load methods are offered by third party service providers and are subject to additional fees. Subject to the applicable Card fees, funds loaded to the Card in-store or via card-to-card transfer will be available immediately after the load is confirmed by us. The time before funds become available may vary for other load methods. Only the Primary Cardholder can load funds onto the Primary Card and the Companion Cards. The funds provided by you to load a Balance onto the Card and the Balance on the Card are not a deposit, and they do not establish a separate individual deposit account with us or any other Canadian financial institution. You will not receive interest on the Balance or on any funds you load onto the Card.

Use of the Card. You may use (a) In case of an internationally valid Card, the Card is valid world-wide except as provided in Clause III (h) herein below.
