The Class Size and Data. The class will consist of approximately 76,189 persons. Defendant will provide confirmation of the number as part of its effort to deliver the class data to the Claims Administrator. Defendant will produce data to the Claims Administrator consisting of the cellular telephone numbers for Class Members that were sent text messages during the Class Period. Claims Administrator will maintain such information confidentially.

The Class Size and Data. The Class will consist of approximately 5,574 unique wireless numbers. Defendants will provide confirmation of the numbers as part of their effort to deliver the class data to the Claims Administrator. To the extent possible, Defendants will produce data to the Claims Administrator consisting of identifying information: names, addresses, and telephone numbers for all Class Members. Claims Administrator will maintain such information confidentially.

  • Class Sizes In the annual assignment of duties, the designated supervisor shall consult with the department in determining appropriate class sizes for individual courses. In making such a determination, the designated supervisor shall consider operational requirements, sound pedagogical principles, and the workload implication of teaching such courses (also see Letter of Understanding #3).

To protect Class Members’ privacy rights, the Administrator must maintain the Class Data in confidence, use the Class Data only for purposes of this Settlement and for no other purpose, and restrict access to the Class Data to Administrator employees who need access to the Class Data to effect and perform under this Agreement. Defendant has a continuing duty to immediately notify Class Counsel if it discovers that the Class Data omitted class member identifying information and to provide corrected or updated Class Data as soon as reasonably feasible. Without any extension of the deadline by which Defendant must send the Class Data to the Administrator, the Parties and their counsel will expeditiously use best efforts, in good faith, to reconstruct or otherwise resolve any issues related to missing or omitted Class Data.
