The City agrees to the following. 1.1. Subject to the terms and conditions established in this Agreement, City shall forego enforcement of its zoning and other land use laws, including the requirement of obtaining a conditional use permit, as they may pertain to the Subject Site and the activities to be conducted thereon by Darling, which activities are described on Exhibit “D” Description of Post-Agreement Darling Operational Statement, attached hereto and incorporated herein.

The City agrees to the following. 1. During the term of this Agreement, the City will not apply chapter 5.40 of the Port Xxxxxxxx Municipal Code to Rasier or TNC drivers accessing the Digital Network, unless such enforcement stems solely and directly from violation of any of the provisions of this Agreement. If Rasier suspends a driver, it will notify the City of that suspension and the resolution of the suspension. The City reserves the right to suspend or revoke an individual driver’s for-hire license. Rasier and TNC drivers accessing the Digital Network are subject to and shall comply with all provisions of State and City law related to “Rules of the Road.”
