Suspensions of Five Calendar Days or Less. If an unrelated offense occurs within three years of a suspension of five calendar days or less, the District may use the prior suspension as the basis for increasing the penalties for the new, unrelated offense. However, if an unrelated offense occurs more than three years after a suspension of five calendar days or less, then the prior offense will not be the basis for increasing the penalty for the new, unrelated offense. There shall be no time limit on the District’s ability to use a prior suspension of five calendar days or less as a basis for increasing the penalty of a new, similar offense.
