Statements Concerning the Company and the Employee. 6.1 The Employee shall refrain, both during the Employment Term and thereafter, from publishing any oral or written statements about the Company, any of its Affiliates or any of such entities’ officers, employees and consultants, agents or representatives that are: (a) slanderous, libelous or defamatory; (b) that disclose Confidential Information about the Company, any of its Affiliates or any of such entities’ business affairs, officers, employees and consultants, agents or representatives; (c) that constitute an intrusion into the seclusion or private lives of any officers, employees and consultants, agents or representatives of the Company or any of its Affiliates; (d) that give rise to unreasonable publicity about the private lives of any officers, employees and consultants, agents or representatives of the Company or any of its Affiliates; (e) that place the Company, any of its Affiliates, or any of such entities’ officers, employees and consultants, agents or representatives in a false light before the public; or (f) that constitute a misappropriation of the name or likeness of the Company, any of its Affiliates or any of such entities’ officers, employees and consultants, agents or representatives; provided, however, that nothing in this Agreement shall apply to or restrict in any way the communication of information by the Employee to any state or federal law enforcement agency or require notice to the Company thereof, and the Employee will not be in breach of the covenant contained above solely by reason of his testimony which is compelled by process of law. The Company and Parent Company shall refrain, both during the Employment Term and thereafter, from publishing any oral or written statements regarding the Employee that are: (a) slanderous, libelous or defamatory; (b) that constitute an intrusion into the seclusion or private lives of the Employee or any member of his family; (c) that give rise to unreasonable publicity about the private lives of the Employee or his family; or (d) that place the Employee or his family in a false light before the public; provided, however, that nothing in this Agreement shall apply to or restrict in any way the communication of information by the Company or Parent Company to any state or federal law enforcement agency or require notice to the Employee thereof, and the Company and Parent Company will not be in breach of the covenant contained above solely by reason of their testimony which is compelled by proces...
