Shift Swaps. 6.20.1 Subject to approval by the appropriate supervisor, an employee may swap a shift with another employee. 6.20.2 Requests for shift swaps must meet the following conditions: (a) Requests for shift swaps will be made at least 48 hours in advance, unless there are exceptional circumstances. At the time the request is made, the employees requesting the shift swap will indicate whether they are electing to be paid in accordance with clause 6.20.3(c) below. (b) The shift swap must allow both employees adequate breaks between shifts. (c) Employees swapping shifts must be of like skill mix in order to meet the job requirements of the shifts to which they swap. (d) The shift swap must be completed within a four week period. 6.20.3 Approved shift swaps will operate on the following basis: (a) Shift swap arrangements will not restrict the Company from making changes to rosters in accordance with this Agreement. (b) Unless both of the employees participating in the shift swap elect to be paid in accordance with clause 6.20.3(c) below, they will be paid as if the shift swap had not occurred. (c) The employees participating in the shift swap may elect to be paid for working the swapped shift on the basis of their own Ordinary Hourly Rate of pay and the Shift, Public Holiday or Weekend Rates applying to the shift worked. Overtime which is continuous with a swapped shift will be treated as overtime continuous with rostered ordinary hours. For the purposes of calculating all other entitlements, including entitlements depending upon ordinary hours worked, the shift swap will be at no additional cost to the Company and the employees participating in the shift swap will be treated as if the shift swap had not occurred. 6.20.4 For the avoidance of doubt, employees are expected to work their rostered shifts in the normal course of events and shift swaps will be refused if the Company believes that excessive numbers of shift swaps are occurring or that shift swaps are interfering with production or training. 6.20.5 In special circumstances, up to two pairs of employees who are rostered to work rotating Day and Afternoon Shifts, may swap shifts (other than the shifts in the Off-cycle Periods) so that one employee in each pair works non-rotating Day Shift and the other employee in the pair works non-rotating Afternoon Shift, on a long-term basis. Any employee may also, subject to existing rules, use sick leave instead of working a substitute shift. However, any employee who uses sick leave in accordance with clause 6.20.3(c) below, they lieu of working two or more scheduled substitute shifts during any 12 month period will be paid as if prohibited from participating in shift swaps for a period of 120 days.
