Common use of Sealing of Derogatory Material Clause in Contracts

Sealing of Derogatory Material. Upon the written request of the unit member, derogatory material that is more than two years old shall be placed in a separate sealed envelope to be retained in the back of the official personnel file. The sealed envelope shall be opened only in the event of a disciplinary investigation or proceeding or in response to a court order or subpoena with prior notice to the employee.
