Scope of Dispute. The Parties hereby submit to final and binding arbitration the dispute described more particularly in the following documents: (a) Statement of Claim and accompanying letter dated May 13, 1996 from Xxxx Xxxxx to Xxx Xxxxx; and (b) Statement of Claim and accompanying letter dated May 13, 1996 from Xxx Xxxxx to Xxxx Xxxxx. The arbitrator shall be Xxxxx X. Xxxxxxx, Esq. (the “Arbitrator”). The Arbitrator shall have the authority to decide such procedural issues as may arise in connection with the arbitration.

Scope of Dispute. Any dispute, controversy or claim arising under, out of or in connection with this Agreement, including any subsequent amendments, or the validity, enforceability, construction, performance or breach thereof, other than the IP Dispute exception provided in Section 16.4 (which shall be settled under the AAA’s Patent Arbitration Rules), including any Matter which the parties do not resolve in accordance with Section 16.1 above (“Dispute”), shall be finally settled under the Rules for Commercial Dispute Resolution Procedures (“Rules”) of the American Arbitration Association (“AAA”) then in force on the date of commencement of the arbitration.

  • Resolution of Dispute Any dispute regarding this Agreement (including without limitation its validity, interpretation, performance, enforcement, termination and damages) shall be determined in accordance with the laws of the State of California, the United States of America. In the event that any person or entity other than the Executive or the Company may be a party with regard to any such controversy or claim, such controversy or claim shall be submitted to arbitration subject to such other person or entity’s agreement. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. This Section 8 shall be specifically enforceable. Notwithstanding the foregoing, this Section 8 shall not preclude either party from pursuing a court action for the sole purpose of obtaining a temporary restraining order or a preliminary injunction in circumstances in which such relief is appropriate; provided that any other relief shall be pursued through an arbitration proceeding pursuant to this Section 8.

  • Settlement of Disputes between a Contracting Party and an Investor of the other Contracting Party
