Right of Ways. Owner shall obtain at its own expense any easements and rights of way over the property of others as required, in order that the personnel and construction equipment of Contractor and its Subcontractors and Vendors have ingress to and egress from the Property Site, except for any transportation rights of way, permits or easements. In addition, Owner shall provide reasonable assistance to Contractor, upon its request, in connection with Contractor’s procurement of any easements and rights of way over the property of others that are necessary for the personnel and construction equipment of Contractor and its Subcontractors and Vendors to have ingress to and egress from portions of the Job Site other than the Property Site, except for any transportation rights of way, permits or easements.

Right of Ways. Landlord will use its best efforts, not including litigation, to cause St. Louis County to vacate the right-of-way for the extension of Xxxxx Avenue upon the dedication to St. Louis County of the extension of Xxxxxxxxxxx Avenue contemplated by Tenant; provided, however, that it is understood and agreed that Landlord shall be entitled to dedicate to St. Louis County a right-of-way up to 82 feet wide on the Premises for the future northward extension of the Xxxxxxxxxxx Avenue Extension. Tenant agrees to take all action reasonably necessary to effectuate such dedication and to allow for the construction of such northward extension.
Right of Ways. The Borrower shall not, and shall not permit any of the Subsidiaries of the Parent or Telergy East to encumber any Right-of-Way for the purpose of incurring or securing after the Closing Date any Debt for Borrowed Money (except those related to the acquisition of such Right-of-Way and provided such encumbrances related only to the Right-of-Way so acquired).
Right of Ways. Seller has not granted any right of ways or easements, except as disclosed in this Agreement, to any party.
Right of Ways. Each of the Crosstex Entities has such consents, easements, rights-of-way, permits or licenses from each person (collectively, “rights-of-way”) as are necessary to conduct its business in the manner described, and subject to the limitations contained, in the Pricing Disclosure Package and the Final Offering Memorandum, except for (i) qualifications, reservations and encumbrances that would not have a Material Adverse Change and (ii) such rights-of-way that, if not obtained, would not have, individually or in the aggregate, a Material Adverse Change; other than as set forth, and subject to the limitations contained, in the Pricing Disclosure Package and the Final Offering Memorandum, each of the Crosstex Entities has fulfilled and performed all its material obligations with respect to such rights-of-way and no event has occurred that allows, or after notice or lapse of time would allow, revocation or termination thereof or would result in any impairment of the rights of the holder of any such rights-of-way, except for such revocations, terminations and impairments that would not have a Material Adverse Change; and, except as described in the Pricing Disclosure Package and the Final Offering Memorandum, none of such rights-of-way contains any restriction that is materially burdensome to the Crosstex Entities, taken as a whole.
