Easement. To the extent applicable, Owner agrees to grant to Bell a non-exclusive easement and statutory right of way and/or a path to the property line from the Building, as the case may be and in or through the Equipment Space if it is determined that a fibre optic cable or such other Equipment must be installed to the Building and/or in the Equipment Space. Owner and Bell shall in advance, agree upon a suitable location to install the fibre optic cable on the property of the Owner. Owner agrees to allow Bell to register, at Xxxx'x expense, the easement and right of way, and/or notice of this Agreement
Easement. The Association is hereby granted an easement of use and right-of-way on, over, in, under and through all building sites in order to comply with the terms of this Declaration, and entry on any building site for such purpose shall not be deemed a trespass.

Easement. Grantor hereby grants the City, its employees, independent contractors and designees, a nonexclusive easement for ingress and egress over, across and under the Development from time to time at the City’s sole discretion to inspect, sample, and monitor components of the Stormwater Facilities and discharges therefrom. Grantor hereby grants to the City permission to undertake the actions described in Sections 6 and 7 of this Agreement. Grantor understands and agrees that this easement limits the ability of Grantor, its successors and assigns, including any Owner(s), from constructing any permanent buildings, structures, landscaping or other improvements that would interfere with the functioning of the Stormwater Facilities or the City’s access to perform the inspection and maintenance required under this Agreement.
Easement. The deed given to the Buyer at the Closing shall convey to Buyer a 100' wide perpetual easement appurtenant to the Premises over a portion of the Seller's Retained Land, as shown on the Survey (the "Easement"). The Easement shall be for the benefit of the Buyer, its successors and assigns, for purposes of installing, maintaining, accessing, inspecting, repairing, replacing, paving, and using: (a) a public trail and associated signage and facilities; (b) underground and above-ground utilities; and (c) a road, which may be paved at Buyer’s option, and associated appurtenances such as lighting, bridges, culverts, drainage, signage, or guardrails, providing vehicular and pedestrian access to and from Field Road and the Premises and any future development or improvements located thereon. The Easement shall be conveyed with metes and bounds, as shown on the Survey. The Easement shall include the right to trim, cut down and remove bushes, shrubbery, trees and other vegetation and growth within the Easement area in connection with Buyer’s use and improvement thereof. The Easement shall be conveyed free from restrictions on Buyer’s use of the Easement area for the above-described purposes, except for the following restrictions, which shall be imposed on the Easement area for the benefit of the premises owned by Xxxxxxxxx X. Liberty located at 000 Xxxxxxxxx Xxxx (Falmouth Tax Map R03, Lot 65) (the “Benefitted Parcel”) and shall be enforceable by Xxxxxxxxx X. Liberty and her successors and assigns: the Easement area shall be (i) maintained in a neat, orderly, well maintained state, (ii) kept free of trash, debris or discarded materials, (iii) kept free of equipment or materials storage, other than the temporary storage of equipment and materials in connection with construction, maintenance, repair, paving or similar activities.
