Common use of Responsibility for Use of Software Clause in Contracts

Responsibility for Use of Software. End User is responsible and liable for all uses of the Software and Documentation through access thereto provided by End User, directly or indirectly. Specifically, and without limiting the generality of the foregoing, End User is responsible and liable to Licensor for any breach or violation of this License by Representatives and for all actions and failures to take required actions with respect to the Software and Documentation, including without limitation actions and failures to take required action by any other Person to whom End User may provide access to or use of the Software and/or Documentation, whether such access or use is permitted by or in violation of this License.
