Responsibilities of Project Participants. The impacts to Covered Species and natural communities resulting from Covered Activities will be minimized and mitigated by the implementation of the BRCP Conservation Strategy, including limitations on take described in BRCP Chapters 4 and 5 by avoidance and minimization measures for Covered Activities described in BRCP Chapter 6, and related application and survey requirements, and by the payment of certain fees that will be used to fund implementation of the BRCP described in BRCP Chapter 9. The avoidance and minimization measures described in BRCP Chapter 6, measures described in BRCP Chapter 8, and the fee requirements described in BRCP Chapter 9 are referred to herein as “Conditions.” Most of these Conditions apply to specific types of Covered Activities; no individual Covered Activity is anticipated to need to comply with all Conditions. Instead, each Covered Activity will comply with certain applicable Conditions. The Permittees will ensure that all applicable Conditions are incorporated in Covered Activities, as provided in this Section.
