Related Application means an Application submitted in the same Funding Cycle that shares one or more Principals or Affiliates of an Applicant or Developer common to any or all of the Principals or Affiliates of an Applicant or Developer in another Application in the same Funding Cycle. Notwithstanding the foregoing, an Application shall not be deemed to be related to another Application if the only Principal or Affiliate of an Applicant or Developer that it shares with such other Application is (i) a Public Housing Authority or an entity created under Section 421.08(8), F.S., or (ii) a Non-Profit as defined in Rule 67-48.002, F.A.C., that is receiving at least 25 percent of the total Developer fee.

Related Application means an Application, whether ----------------------------------- international or in the same or another country or region, which (1) is substantially the same as (e.g., it does not include any new matter in the sense of the United States Patent Law) an Application or Patent listed in Appendix A, entitled "Scheduled Patents and Applications," which is attached hereto and forms an integral part of this Agreement (for example, without limiting the foregoing, a continuation Application, a corresponding Application, an Application to reissue, or a re-filed Application), or (2) is substantially only a portion of (e.g., it contains less than an Application or Patent listed in Appendix A and, it does not include any new matter in the sense of the United States Patent Law) an Application or Patent listed in Appendix A (for example, a divisional Application, or a corresponding or re-filed Application in the nature of a divisional Application).

• Notwithstanding the above, all rights to any modifications to the Related Application shall belong to the Supplier and the User shall do all things necessary to vest such rights in the Supplier.

• In the event that any such infringement occurs or may occur, the Supplier may at its sole option and expense: procure for the User the right to continue using the Related Application or infringing part thereof; or modify or amend the Related Application or infringing part thereof so that the same becomes non-infringing; or refund of Annual Subscription Fee paid for the balance of the year of the Term.

Related Application or “Related Applications” means any and all applications related to the patent(s) referenced in the request, any continuations, continuations-in-part, divisions, interferences, reexaminations, reissues, parents, foreign counterpart applications, and any other applications disclosing, describing, or claiming any invention disclosed, described, or claimed in the referenced patent or patents, or claiming the benefit of the filing date of any application whose benefit is claimed in the referenced patent or patents, whether or not abandoned and whether or not issued.

Related Application means any parent or other ancestral U.S. or foreign application related in any way to the patents-in-suit and any continuing application, continuation- in-part application, divisional application, file-wrapper continuation, reexamination proceeding, reissue application, abandoned application or foreign counterpart application thereof.

Related Application of the Pending Application is patent application that is entitled to the priority afforded the Pending Application, is based on at least one patent application in common with the Pending Application, includes disclosures of all of the subject matter described in the Pending Application and can reasonably claim the subject matter recited in the claims of the Pending Application in the same patent office in which the Pending Application is being prosecuted; and a “Final Application” is a Pending Application which has no co-pending Related Applications. For the purposes of this section, the right to prosecute and maintain a Patent Application includes the right to file one or more continuation applications, continuation-in-part applications and divisional applications.
