REPRESENTATIONS AND WARRANTIES OF SYMANTEC. Symantec hereby represents and warrants that it has authorized the person who has signed this Agreement for Symantec to execute and deliver this Agreement to Quarterdeck on behalf of Symantec, and Symantec has the full power and authority to enter into this Agreement and fulfill the obligations set forth herein.
REPRESENTATIONS AND WARRANTIES OF SYMANTEC. Symantec hereby represents and warrants, except as set forth in the exception letter, delivered by Symantec to Buyer (the "SYMANTEC EXCEPTION LETTER") herewith (including, without limitation, the section and subsections of the Symantec Exception Letter referred to below in this Article 3) as set forth below. The designation of an item in the Symantec Exception Letter as an exception to any section or subsection of this Agreement shall not cause such item to be an exception to any other applicable section or subsection unless it is evident from the language of the exception itself (as distinguished from the content of any documents listed in the Symantec Exception Letter) that such exception would be applicable to another section or subsection of this Agreement.
