Reliance on SCCs. Where We rely on SCCs then in Our role as the data importer We will assess whether the laws applicable to Us provide adequate protection under relevant DPLs. To the extent We determine that any such laws are likely to have a substantial adverse effect on the level of protection offered by the SCCs and required under applicable DPL in respect of Personal Data in your Content and/or Smart Data, We shall comply with Section 11.5 below. If We do not reach such a determination then Section 11.5 shall not apply.

  • Severability Any provision of this Agreement that is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof, and any such prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.
