Our Role. In its role as auctioneer of Lots, Gorringe’s acts solely for and in the interests of the Seller. Gorringe’s job is to sell the Lot at the highest price obtainable at the Sale to a Bidder. Gorringe’s does not act for Buyers or Bidders in this role and does not give advice to Buyers or Bidders. When it or its staff make statements about a Lot or, if Gorringe’s provides a Condition Report on a Lot it is doing that on behalf of the Seller of the Lot. Xxxxxxx and Buyers who are themselves not expert in the Lots are strongly advised to seek and obtain independent advice on the Lots and their value before bidding for them. The Seller has authorised Gorringe’s to sell the Lot as its agent on its behalf and, save where we expressly make it clear to the contrary, Gorringe’s acts only as agent for the Seller. Any statement or representation we make in respect of a Lot is made on the Seller’s behalf and, unless Gorringe’s sells a Lot as principal, not on our behalf and any Contract for Sale is between the Buyer and the Seller and not with us. If Gorringe’s sells a Lot as principal this will either be stated in the Catalogue or an announcement to that effect will be made by the Auctioneer, or it will be stated in a notice at the Sale or an insert in the Catalogue. Gorringe’s does not owe or undertake or agree to any duty or responsibility to you in contract or tort (whether direct, collateral, express, implied or otherwise). If you successfully bid for a Lot and buy it, at that stage Gorringe’s does enter into an agreement with the Buyer. The terms of that contract are set out in our Buyer’s Agreement. This will govern Gorringe’s relationship with the Buyer.
Our Role. 1.1 GoFetch provides the marketplace Both practically and legally it is Fetchers, and not GoFetch, that perform Jobs for Customers. GoFetch’s role is to provide a marketplace (via the Platform) for Customers and Fetchers to agree Jobs. GoFetch is not a delivery company and is not responsible for the performance of any Job. In performing Jobs, Fetchers are not employees or subcontractors of GoFetch. Similarly, both practically and legally, Fetchers do not perform Jobs for GoFetch – they perform them directly for Customers, and GoFetch is not responsible for any breach or conduct of any Customer. Having said that, GoFetch does provide certain services to Customers and Fetchers, and imposes certain obligations on Customers and Fetchers, to make the Platform a good place for Customers to request Jobs and Fetchers to agree to perform them. This agreement sets out the services GoFetch provides to you as a Fetcher, and your obligations to us as a Fetcher.
Our Role. 1.1 The Payments Solution (“Services”) is a payment processing service that helps the Partner integrate with a payment processor (the “Payment Processor”) as set out in this Payments Agreement, allowing the Partner to accept payments from Customers (as defined below) online via platforms provided by BRS Golf.

Our Role. The Digital Services include a platform for vehicle and other item listings and information services. We are not the creator or owner of the items posted on the Digital Services by Sellers for Buyers to bid on. Sellers are responsible for ensuring that any of their User Content meets all applicable local, state, provincial, national and other laws, rules and regulations, and that any goods (including vehicles) and services promoted, offered or otherwise described on the Digital Services are described in listings, and/or delivered as described, in an accurate satisfactory manner. For any payment processing related to Purchases made on the Digital Services, if the Seller or third party responsible for the applicable vehicle or other good or service selects a payment processing method that uses a third party to process the payment, then we do not process that payment transaction. As part of the Digital Services, the Company may assist Sellers in the creation of their listings (including the content of such listing) but it remains each Seller’s responsibility to make sure that its listings are accurate. THE COMPANY IS NOT AN AUTOMOBILE BROKER, DEALER OR TRADITIONAL AUCTIONEER AND WE DO NOT SELL, EXCHANGE, BUY, OR OFFER FOR SALE, NEGOTIATE OR ATTEMPT TO NEGOTIATE, A SALE OR EXCHANGE OF AN INTEREST IN ANY VEHICLE LISTED ON THE DIGITAL SERVICES. THE COMPANY HAS NEVER: (I) HELD TITLE FOR ANY VEHICLE LISTED ON THE DIGITAL SERVICES, (2) INSPECTED ANY VEHICLE LISTED ON THE DIGITAL SERVICES OR (3) HAD ANY VEHICLES LISTED ON THE DIGITAL SERVICES IN ITS LEGAL POSSESSION.
Our Role. We (the Company) will provide you, or arrange for you to receive, the Enhancements. We do not, however, engage in the practice of medicine or provide any diagnostic, therapeutic or clinical services; nor does the Company make any assurance or guarantee that any treatment or procedure provided by your Physician or the Practice will be successful. No act or service required or permitted to be rendered by the Company pursuant to this Agreement should be construed or deemed to constitute the practice of medicine.
