Rancho Palos Verdes Covered Species. If a RPV Covered Species is not listed as threatened or endangered under the ESA as of the Effective Date, and becomes so listed during the term of this Agreement, then the Section 10(a)(I)(B) Permit shall become effective with respect to such species concurrent with its listing as threatened or endangered. The NCCP Act Authorization authorizes incidental take of all RPV Covered Species except five fully protected species from the Effective Date of Take Authorizations; for that reason, the subsequent CESA listing or candidate status of a RPV Covered Species will have no effect on the scope of the NCCP Act Authorization.
