Common use of Provincial Emergency Program Clause in Contracts

Provincial Emergency Program. In the case of a declared State of Emergency: a) which will result in overtime work being performed by any Employee of the Employer; and, b) for which the Employer received compensation from the Provincial Emergency Program, the compensation associated with the overtime work performed by the Employee will be paid out to the Employee in the next pay period at the applicable rate for the overtime work (i.e. the Employee cannot elect to bank the overtime compensation in order to be taken as time off in lieu at a later date). Any overtime work which is performed by an Employee during the declared State of Emergency, but which is not associated with the State of Emergency and as a consequence is not subject to compensation by the Provincial Emergency Program, will be subject to the applicable provisions set out in the Collective Agreement concerning compensation for overtime work.
