PROJECT GUIDELINES. FACILITY USE The facility shall be used only for the purposes specified in this application. The licensee agrees to use the facility in such a manner so as to comply with all state, county, and municipal orders and regulations; and not to use the facility or permit the same to be used for any disorderly or unlawful purposes. Failure to use the facility in conformity with the purposes specified in this application will be considered a violation of this agreement. The County may terminate this agreement and immediately re-take possession of the facility for any violation of this agreement. • Under no circumstances should the licensee or organization make any alterations to the park facility that has not been outlined in the agreement and approved by the County. The facility should be returned to its normal condition except for normal wear. • The Department of Recreation, Parks & Tourism reserves the right to restrict groups from providing alcoholic beverages on its premises. Alcoholic beverages are not permitted during community projects. • Groups shall observe the approved times for commencement and conclusion of the activity as requested in this agreement. • Camping and campfires are not permitted on Park Property. Fires shall be confined to the barbecue grills only. • All trash must be properly disposed of in receptacles provided for the purpose. • The Department of Recreation, Parks & Tourism reserves the right to refuse or cancel this agreement for any reasonable cause. Every attempt will be given to provide the organization adequate notice. • Licensee shall not amend this agreement or transfer project management to any other person or persons without the prior written consent of the Department.
PROJECT GUIDELINES. The Authority and TICD have embarked on an iterative public planning and review process to create a mixed-use redevelopment project on Treasure Island and Yerba Buena Island (the "Project"). The planning effort includes an unprecedented level of community involvement and input, and is based on the goals, objectives and guidelines for the Project that are identified in the Reuse Plan, the RFQ, the RFP and the ENA. These documents, and the information obtained from the public, require the Project to comply with the Tidelands Trust, seismically stabilize the perimeter of Treasure Island, and provide extensive public benefits to the City such as significant amounts of new affordable housing, increased public access and open space, transportation improvements, and recreational and entertainment opportunities, while creating jobs and a vibrant, sustainable community. The Project has been structured to provide fiscal neutrality to the City's General Fund such that these extraordinary Project benefits can be delivered without negatively impacting the City's General Fund. This iterative planning effort included significant interaction between TICD and interested members of the public, the Authority staff, the TICAB and the Authority Board. The extensive public participation process included approximately 150 public meetings, public workshops and design charettes, and resulted in a comprehensive conceptual development program that is articulated in separate plans for land use/open space, phasing and transition, infrastructure, affordable housing, sustainability, transportation, economic development and jobs, community facilities and emergency planning and preparedness. VCRG may, in its sole discretion, increase the foregoing data limit for certain lines of service for certain smartphones and tablets. ● VCRG will terminate wireless service to the devices being used by the participants at the end of the Project. The following limitations are placed on each device within the Project: ● No billable or paid applications (apps) shall be downloaded. ● Personal hotspots on the device shall not be used. ● Hardware (i.e. SIM chip) or software shall not be removed from the device unless authorized by VCRG. ● Devices can only be used within the 50 states of the United States of America. ● No calls, text, video or picture messages can be made to Canada, Mexico or other international locations. ● Roaming charges are not permitted. ● If a device is lost, stolen or damaged, it must be reported immediately by the participant to the school principal who must notify the SBBC Lead who in turn must notify Digital Promise who in turn must notify VCRG Lead immediately. ● Digital Promise, Verizon Wireless or VCRG can suspend or terminate service at any time, without notice. ● VCRG will actively monitor the devices and wireless accounts monthly for Project compliance. ● Should any End User exceed the maximum allowable data for the monitoring period, the following Project Violations Policy will apply: o Data usage of 10 GB or more over the program limit in any month will result in a warning the first time the excess usage occurs. If the participant exceeds the data usage limit a second time, the service will be suspended, and the participant will be removed from the program. o Upon removal from the program and collection of the assigned device, the device may be reassigned to a new program participant. Notification of the change must be made to VCRG for reactivation of the service to the device. ● Devices will be shipped directly from Verizon to each Project site. ● Identification of a Project lead and his/her respective contact information must be conveyed to Digital Promise. ● It is the responsibility of the local Lead to communicate the guidelines on the Project, device and data usage compliance to the Project participants.

PROJECT GUIDELINES. Program funding shall be utilized solely for the purposes of road improvements to roads under the jurisdiction of local cities and villages. Road improvements may include, but not be limited to, paving, resurfacing, lane additions or lengthening, bridges, or drainage as such improvements relate to road safety, structure or relieving congestion. Program funding: • May be utilized to supplement a local government's matched funding for the purposes of receiving additional federal transportation funding; • May not be utilized to fulfill a local government's responsibility to fund improvements to state trunklines; • Shall be limited to real capital improvements to roadways and shall not be utilized for other purposes, such as administrative expenses, personnel, consultants or other similar purposes; • Shall not be utilized for non-motorized improvements, unless these improvements are included in a project plan for major improvements to a motorized roadway; • Shall be utilized for projects that will result in a measurable improvement in the development of the local economy and contribute to business growth. Recipients shall be responsible for providing an outline of the economic benefits of the project prior to approval and for reporting to the Board of Commissioners after the completion of the project on the benefits achieved as a result of the projects. Local Road Improvement Matching Fund Program projects may be appropriated by the Board of Commissioners in compliance with the County budget process. The amount of funds to be dedicated for the Program shall be determined by the Board of Commissioners on an annual basis. Program funding may be reduced or eliminated based upon the ability of the County government to meet primary constitutional and statutory duties. The Board of Commissioners expressly reserves the right to adjust the County matching funds share at any time based upon County budget needs. In accordance with MCL 123.872, funds dedicated to the Local Road Improvement Matching Fund Program shall not be derived from ad valorem tax revenues. Program funding shall be limited to funds derived from the County's distribution from the Michigan General Revenue Sharing Act. Reduction or elimination of the County's distribution of revenue sharing funds may result in the elimination or suspension of the program. Funding availability shall be distributed based upon a formula updated annually. The formula will consist of:

The County has established the following guidelines, criteria, goals, objectives, constraints, schedule, budget and or requirements which shall serve as a guide to the Bidder(s) in performing the Work provided for pursuant to this Contract: 22.1.1. No amount of Work is guaranteed upon the execution of a Contract. 22.1.2. Rates and all other negotiated expenses shall remain in effect throughout the duration of the Contract period inclusive of any renewals unless otherwise specified herein. 22.1.3. This Contract does not entitle any Bidder to exclusive rights to County contracts. In reference to vehicle travel, mileage and man-hours spent in travel, time is considered incidental to the Work and not an extra compensable expense. 22.1.5. Lee County reserves the right to add or delete, at any time, any or all material, tasks or services associated with this Contract.
