Common use of Policies of Insurance Clause in Contracts

Policies of Insurance. Each of the copies of the policies, declaration pages, original binders and certificates of insurance evidencing the Policies of Insurance as required under Section 5.09 with respect to the Hotel/Casino Facility and each component of the Real Property delivered to Agent Bank by Borrowers (i) is a true, correct and complete copy of the respective original thereof as in effect on the date hereof or thereof, without amendments or modifications of any of said documents or instruments not included in such copies, and (ii) has not been terminated and is in full force and effect. Borrowers are not in default in the observance or performance of its obligations under said documents and instruments, and Borrowers have all things

Each As of the Closing Date, each of the copies of the policies, declaration pages, original binders and certificates of insurance evidencing the Policies of Insurance as required under Section 5.09 with respect relating to the Hotel/Casino Facility Facilities and each component of the Real Property ACLVI Project delivered to Agent Bank by Borrowers (i) is a true, correct and complete copy of the respective original thereof as in effect on the date hereof or thereofhereof, without and no amendments or modifications of any of said documents or instruments not included in such copiescopies have been made, and (ii) has not been terminated and is in full force and effect. Borrowers are not in default in the observance or performance of its their respective obligations under said documents and instruments, and Borrowers have done all thingsthings required to be done as of the Closing Date to keep unimpaired their respective rights thereunder.

Each As of the Closing Date, each of the copies of the policies, declaration pages, original binders and certificates of insurance evidencing the Policies of Insurance as required under Section 5.09 with respect relating to the Hotel/Casino Facility and each component of the Real Property Expansion Project delivered to Agent Bank by Borrowers Borrower (i) is a true, correct and complete copy of the respective original thereof as in effect on the date hereof or thereofhereof, without and no amendments or modifications of any of said documents or instruments not included in such copiescopies have been made, and (ii) has not been terminated and is in full force and effect.
