Common use of Phrases Clause in Contracts

Phrases. Except as expressly set forth in this Agreement to the contrary, when used in this Agreement, the phrase “including” shall mean “including, but not limited to,” the term “satisfactory” or “acceptable” with reference to any matter to be reviewed or approved by Senior Lender shall mean in form and substance satisfactory to Senior Lender in its sole and absolute discretion; references to the “consent” or “approval” of Senior Lender shall mean such consent or approval in Senior Lender’s sole and absolute discretion; and references to the “consent” or “approval” of Mezzanine Lender shall mean such consent or approval in Mezzanine Lender’s sole and absolute discretion.
