The "Pay During Proceeding" clause requires one party to continue making payments to the other while a dispute or legal proceeding is ongoing. In practice, this means that even if there is a disagreement—such as over the quality of work or the amount owed—payments must still be made according to the contract's schedule until the issue is resolved. This clause ensures that cash flow is maintained and prevents one party from using non-payment as leverage during a dispute, thereby promoting fairness and stability in the contractual relationship.
Pay During Proceeding. One representative of the Union, and all necessary employee witnesses shall receive their regular salaries or wages for the time spent in the grievance mediation proceeding, if such proceeding is held during regular working hours.

  • Rejection During Probation ‌ (a) The Employer may reject any probationary employee for just cause. A rejection during probation shall not be considered a dismissal for the purpose of Clause 10.

  • Refund During Cooling-Off Period The PEI will provide the Student with a cooling-off period of seven (7) working days after the date that the Contract has been signed by both parties. The Student will be refunded the highest percentage (stated in Schedule D) of the fees already paid if the Student submits a written notice of withdrawal to the PEI within the cooling-off period, regardless of whether the Student has started the course or not.

  • Union Activity During Working Hours Solicitation of Union membership or collection or checking of dues will not be conducted during working time. The Company agrees not to discriminate in any way against any employee for Union activity, but such activity shall not be carried on during working time, except as specifically allowed by the provisions of this Agreement.

  • Data Protection During Transmission DST shall encrypt, using an industry standard encryption algorithm, personally identifiable Fund Data when such data is transmitted.
