Common use of Other Employee Benefit Plans Clause in Contracts

Other Employee Benefit Plans. During the Employment Period, the Employee and/or the Employee’s family, as the case may be, shall be eligible for participation in all benefit plans and programs currently and hereafter maintained by the Company as set forth in the Company’s Employee Handbook (the “Handbook”). The Employee shall be eligible for participation in fringe benefits and perquisite plans, practices, policies and programs (including, without limitation, expense reimbursement plans, practices, policies and programs) on a basis that is commensurate with his/her position and no less favorable than those generally applicable or made available to most other Employees of the Company. Modification of this paragraph, if any, will be included on Exhibit B, attached hereto. Should Employee decline any benefit plans and programs offered by the Company, the Company has no obligation to pay Employee any amount as additional compensation. In each case, Employee’s participation in any such plan or program shall be subject to the eligibility requirements set forth in the Handbook. Notwithstanding anything in this Agreement to the contrary, the Company shall have the right to cancel or change the benefit plans and programs at any time and without prior notice and shall have no liability to Employee in consequence of any such cancellation or change.
