Other Delivery Vehicle Party Winding Up. Where any other Delivery Vehicle Party is a Winding Up Delivery Vehicle Party (in circumstances where the Delivery Vehicle is not a Winding Up Delivery Vehicle Party), a Winding Up Practitioner shall be appointed in respect of such Delivery Vehicle Party within 30 Working Days of the date upon the later of the relevant Termination Event first occurs and, if applicable, the date upon which Clause 20.1.3 first applies in respect of such Delivery Vehicle Party, and shall be instructed to wind up the relevant Delivery Vehicle Party and its business (only) in an efficient manner and to ensure that its Partnership Assets shall be distributed in accordance with Clause 21.

  • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where SPARDI has requested an Unbundled Loop and BellSouth uses Integrated Digital Loop Carrier (IDLC) systems to provide the local service to the end user and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to SPARDI. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for SPARDI (e.g. hairpinning):

  • PRODUCT DELIVERY Delivery must be made as ordered to the address specified on the Purchase Order and in accordance with the terms of the Contract or Contract Award Notice. Unless otherwise specified in the Bid Documents, delivery shall be made within thirty calendar days after receipt of a Purchase Order by the Contractor. The decision of the Commissioner as to compliance with delivery terms shall be final. The burden of proof for delay in receipt of Purchase Order shall rest with the Contractor. In all instances of a potential or actual delay in delivery, the Contractor shall immediately notify the Commissioner and the Authorized User, and confirm in writing the explanation of the delay, and take appropriate action to avoid any subsequent late deliveries. Any extension of time for delivery must be requested in writing by the Contractor and approved in writing by the Authorized User. Failure to meet such delivery time schedule may be grounds for cancellation of the order or, in the Commissioner’s discretion, the Contract.
