Common use of OBLIGATIONS, LIABILITIES, AND RIGHTS Clause in Contracts

OBLIGATIONS, LIABILITIES, AND RIGHTS. Any EMPLOYEE who is adjudged liable for damages resulting from actions taken pursuant to: Board policy; regulations or custom; Florida Administrative Code Rule; or Florida State Statute may be reimbursed in the amount of damages assessed. However, no reimbursement or indemnification shall be permitted where the individual has been adjudged guilty of gross negligence or willful misconduct in the performance of duties.
