Common use of Notice of Reopener Clause in Contracts

Notice of Reopener. This Agreement shall be automatically renewed from year 7 to year and shall be binding for additional periods of one year unless either the 8 Employer or the Association gives written notice to the other of its desire to open 9 negotiations for a new agreement not less than ninety (90) days nor more than 10 one hundred twenty (120) days prior to the aforesaid expiration date. Whenever 11 such written notice is given as provided herein, this Agreement shall remain in 12 full force and effect during the period of negotiations, and may be terminated 13 upon written notice by either party, subsequent to the expiration date, declaring 14 that impasse has been reached.

Whenever 11 24 such written notice is given as provided herein, this Agreement shall remain in 12 full force and effect 25 during the period of negotiations, and may be terminated 13 upon written notice by either party, 26 subsequent to the expiration date, declaring 14 that impasse has been reached.
